  1.1                          A bill for an act 
  1.2             relating to retirement; specifying pension coverage 
  1.3             for certain former Anoka County employees; amending 
  1.4             Minnesota Statutes 2002, section 353F.02, subdivisions 
  1.5             5, 6. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 353F.02, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [OTHER PUBLIC EMPLOYING UNIT.] "Other public 
  1.10  employing unit" means: 
  1.11     (1) Metro II, a joint powers organization formed under 
  1.12  section 471.59; and 
  1.13     (2) the St. Paul Civic Center authority; and 
  1.14     (3) Anoka County, with respect to persons employed by the 
  1.15  county's achieve program for adults with developmental 
  1.16  disabilities. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 353F.02, 
  1.18  subdivision 6, is amended to read: 
  1.19     Subd. 6.  [TERMINATED MEDICAL FACILITY OR OTHER PUBLIC 
  1.20  EMPLOYING UNIT EMPLOYEE.] "Terminated medical facility or other 
  1.21  public employing unit employee" means a person who: 
  1.22     (1) was employed on the day before the effective date by 
  1.23  the medical facility or other public employing unit; or 
  1.24     (2) terminated employment with the medical facility or 
  1.25  other public employing unit on the day before the effective date 
  2.1   or on the effective date; and 
  2.2      (3) was a participant in the general employees retirement 
  2.3   plan of the Public Employees Retirement Association at the time 
  2.4   of termination of employment with the medical facility or other 
  2.5   public employing unit. 
  2.6      Sec. 3.  [EFFECTIVE DATE.] 
  2.7      (a) Section 1 is effective upon the latter of: 
  2.8      (1) the conclusion of the last day of the Anoka County pay 
  2.9   period during which the governing body of Anoka County and its 
  2.10  chief clerical officer timely complete compliance with Minnesota 
  2.11  Statutes, section 645.021, subdivisions 2 and 3; and 
  2.12     (2) the conclusion of the last day of the Anoka County pay 
  2.13  period during which the executive director of the Public 
  2.14  Employees Retirement Association certifies to the Anoka County 
  2.15  Board that the actuarial accrued liability of the special 
  2.16  benefit coverage proposed for extension to the privatized Anoka 
  2.17  County achieve program employees under section 1 does not exceed 
  2.18  the actuarial gain otherwise to be accrued by the Public 
  2.19  Employees Retirement Association, as calculated by the 
  2.20  consulting actuary retained by the Legislative Commission on 
  2.21  Pensions and Retirement.  The cost of the actuarial calculations 
  2.22  must be borne by Anoka County. 
  2.23     (b) Section 2 is effective the day following final 
  2.24  enactment.
