A bill for an act
relating to health insurance; requiring health plans to be offered anytime during
the calendar year; providing requirements; proposing coding for new law in
Minnesota Statutes, chapter 62Q.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [62Q.678] HEALTH PLAN OPEN ENROLLMENT.

new text begin (a) All health plans must be made available in the manner required by Code of
Federal Regulations, title 45, section 147.104.

new text begin (b) In addition to the requirements of paragraph (a), any health plan for individuals
that is not purchased through MNsure, as established in chapter 62V:

new text begin (1) must be made available for purchase at any time during the calendar year; and
new text end

new text begin (2) is subject to a waiting period of not more than 90 days after the day on which
the application for coverage was received;

new text begin (c) is effective upon the first day of the month immediately succeeding the month
in which the waiting period expires; and

new text begin (d) is not retroactive from the date on which the application for coverage was received.
