  1.1                          A bill for an act 
  1.2             relating to human services; establishing a downsizing 
  1.3             pilot project for two ICF/MR located in Lyon county. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [ICF/MR PILOT PROJECT.] 
  1.6      Subdivision 1.  [ESTABLISHMENT.] The commissioner of human 
  1.7   services shall establish a pilot project in Lyon county to 
  1.8   downsize two intermediate care facilities for persons with 
  1.9   mental retardation (ICF/MR).  Each of the two facilities that 
  1.10  currently serve 15 persons shall be downsized to eight persons 
  1.11  per building.  Each facility's aggregate investment-per-bed 
  1.12  limit in effect before downsizing must be the facility's 
  1.13  aggregate investment-per-bed limit after downsizing. 
  1.14     Subd. 2.  [WAIVERED SERVICES.] The commissioner shall 
  1.15  authorize home and community-based waivered services slots for 
  1.16  each person discharged from the facilities as a result of the 
  1.17  downsizing.  The average medical assistance rate for home and 
  1.18  community-based services must not exceed the rate made available 
  1.19  in law.
