  1.1                          A bill for an act
  1.2             relating to energy; allowing a St. Paul district 
  1.3             heating cogeneration facility that utilizes 
  1.4             metropolitan waste wood as a fuel source to count 
  1.5             toward satisfying a biomass mandate. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [ST. PAUL DISTRICT HEATING AND COOLING 
  1.8   FACILITY; BIOMASS MANDATE.] 
  1.9      Electric energy produced at a district heating and cooling 
  1.10  cogeneration facility in St. Paul shall count toward 
  1.11  satisfaction of the amount of biomass energy required by 
  1.12  Minnesota Statutes, section 216B.2424, clause (1), that a public 
  1.13  utility operating a nuclear facility in this state must 
  1.14  construct and operate, purchase, or contract to construct and 
  1.15  operate by December 31, 1998.  The electric energy produced at a 
  1.16  St. Paul district heating and cooling facility must count toward 
  1.17  satisfaction of this mandate only if (1) the electric energy is 
  1.18  produced in a cogeneration process that utilizes as a primary 
  1.19  fuel source nonhazardous metropolitan tree trimmings and other 
  1.20  nonhazardous metropolitan waste wood, including but not limited 
  1.21  to, wood that would otherwise be landfilled or burned in a 
  1.22  process not designed to reclaim and use the energy contained 
  1.23  therein; and (2) the cogenerated thermal load of the facility 
  1.24  replaces a thermal load produced by nonrenewable fuels.
