  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the private sale 
  1.3             of certain surplus state land in Houston county. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [PRIVATE SALE OF SURPLUS STATE LAND; HOUSTON 
  1.6   COUNTY.] 
  1.7      (a) Notwithstanding Minnesota Statutes, sections 94.09 and 
  1.8   94.10, or any other law to the contrary, the commissioner of 
  1.9   natural resources may convey by private sale the surplus state 
  1.10  land described in paragraph (c).  
  1.11     (b) The land described in paragraph (c) may be sold by 
  1.12  private sale to Pat White of Houston county, Minnesota.  The 
  1.13  conveyance must be in a form approved by the attorney general.  
  1.14     (c) The land to be conveyed is located in Houston county, 
  1.15  consists of about .14 acre, and is described as: 
  1.16     All that part of the CMC Real Estate Corporation's (the 
  1.17  former Chicago, Milwaukee, St. Paul and Pacific Railroad 
  1.18  Company) real property in Government Lot 2, Section 25, Township 
  1.19  102 North, Range 4 West, Houston county, Minnesota, lying 
  1.20  northwesterly of a line parallel with and 50 feet 
  1.21  perpendicularly distant northwesterly of the center line of the 
  1.22  Soo Line Railroad Company's main track, and being a strip of 
  1.23  land 40 feet in width, lying northerly of, adjacent and 
  1.24  contiguous to the following described line:  
  2.1      Commencing at the southwest corner of said Government Lot 2 
  2.2   from which the northwest corner of said Government Lot 2 bears 
  2.3   North 01 degree 37 minutes 43 seconds East, bearing based on the 
  2.4   Houston County Coordinate System of 1983; thence North 14 
  2.5   degrees 32 minutes 00 seconds East 536.38 feet to the west line 
  2.6   of said CMC Real Estate Corporation's real property and the 
  2.7   point of beginning of the line to be described; thence South 66 
  2.8   degrees 33 minutes 17 seconds East 150.00 feet to a point on a 
  2.9   line parallel with and 50 feet perpendicularly distant 
  2.10  northwesterly of the center line of the said Soo Line Railroad 
  2.11  Company's main track and there terminating.  
  2.12     (d) The commissioner of natural resources has determined 
  2.13  that the land conveyance would have no impact on the adjacent 
  2.14  public access site and that the land would be put to better use 
  2.15  if returned to private use.
