  1.1                          A bill for an act 
  1.2             relating to government operations; expanding 
  1.3             Minneapolis health insurance subsidy to include 
  1.4             eligible Minneapolis teachers who retire before May 1, 
  1.5             1983; amending Minnesota Statutes 1994, section 
  1.6             124.916, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 124.916, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [MINNEAPOLIS HEALTH INSURANCE SUBSIDY.] Each year 
  1.11  special school district No. 1, Minneapolis, may make an 
  1.12  additional levy not to exceed the amount raised by a net tax 
  1.13  rate of .10 percent times the adjusted net tax capacity for 
  1.14  taxes payable in 1991 and thereafter of the property in the 
  1.15  district for the preceding year.  The proceeds may be used only 
  1.16  to subsidize health insurance costs for eligible teachers as 
  1.17  provided in this section.  
  1.18     "Eligible teacher" means a retired teacher who was a basic 
  1.19  member of the Minneapolis teachers retirement fund association, 
  1.20  who retired before May 1, 1974 June 30, 1983, and who is not 
  1.21  eligible to receive the hospital insurance benefits of the 
  1.22  federal Medicare program of the Social Security Act without 
  1.23  payment of a monthly premium.  The district shall notify 
  1.24  eligible teachers that a subsidy is available.  To obtain a 
  1.25  subsidy, an eligible teacher must submit to the school district 
  1.26  a copy of receipts for health insurance premiums paid.  The 
  2.1   school district shall disburse the health insurance premium 
  2.2   subsidy to each eligible teacher according to a schedule 
  2.3   determined by the district, but at least annually.  An eligible 
  2.4   teacher may receive a subsidy up to an amount equal to the 
  2.5   lesser of 90 percent of the cost of the eligible teacher's 
  2.6   health insurance or up to 90 percent of the cost of the number 
  2.7   two qualified plan of health coverage for individual policies 
  2.8   made available by the Minnesota comprehensive health association 
  2.9   under chapter 62E.  
  2.10     If funds remaining from the previous year's health 
  2.11  insurance subsidy levy, minus the previous year's required 
  2.12  subsidy amount, are sufficient to pay the estimated current year 
  2.13  subsidy, the levy must be discontinued until the remaining funds 
  2.14  are estimated by the school board to be insufficient to pay the 
  2.15  subsidy. 
  2.16     This subdivision does not extend benefits to teachers who 
  2.17  retire after June 30, 1983, and does not create a contractual 
  2.18  right or claim for altering the benefits in this subdivision.  
  2.19  This subdivision does not restrict the school district's right 
  2.20  to modify or terminate coverage under this subdivision.
