  1.1                          A bill for an act 
  1.2             relating to state government; requiring state agencies 
  1.3             to take certain actions to promote bicycle commuting 
  1.4             by state employees; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 16B. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [16B.561] [BICYCLE COMMUTING; USE BY STATE 
  1.8   EMPLOYEES.] 
  1.9      Subdivision 1.  [EMPLOYEE TRANSPORTATION PROGRAM.] To 
  1.10  conserve energy, alleviate traffic congestion around state 
  1.11  offices, improve employee health through increased physical 
  1.12  activity, decrease demand for motor vehicle parking, and 
  1.13  minimize the environmental impact of commuting by singly 
  1.14  occupied motor vehicles, the commissioner shall, in cooperation 
  1.15  with the commissioners of transportation, health, and public 
  1.16  service, and interested nonprofit agencies, establish and 
  1.17  operate an employee transportation program promoting bicycle 
  1.18  commuting by state employees.  The commissioner shall promote 
  1.19  the maximum participation of state employees in the use of the 
  1.20  bicycles for commuting. 
  1.21     Subd. 2.  [CAPITAL INVESTMENT.] No state agency may propose 
  1.22  or implement a capital investment plan for a state office 
  1.23  building unless: 
  1.24     (1) the agency has developed a plan for increasing bicycle 
  1.25  commuting by employees who would normally work in the building, 
  2.1   or the agency has prepared a statement describing why such a 
  2.2   plan is not practicable; and 
  2.3      (2) the plan or statement has been reviewed by the 
  2.4   commissioner. 
  2.5      Subd. 3.  [FACILITY PROVISION.] (a) All state agencies 
  2.6   shall provide facilities which promote bicycle commuting by 
  2.7   state employees.  These facilities might include indoor or 
  2.8   sheltered bicycle parking, high-security bicycle parking, 
  2.9   showers, and dressing areas for bikers.  
  2.10     (b) The commissioner of administration must install bicycle 
  2.11  racks outside of all state-owned buildings that the commissioner 
  2.12  determines state employees or members of the public travel to by 
  2.13  bicycle.  Costs of the bicycle racks may be paid for from state 
  2.14  building repair and replacement accounts, from parking revenue 
  2.15  collected under section 16B.58, or from other appropriations for 
  2.16  this purpose. 
  2.17     (c) Paragraph (b) does not apply to buildings used by the 
  2.18  Minnesota state colleges and universities, but each Minnesota 
  2.19  state colleges and universities institution must provide bicycle 
  2.20  racks that are sufficient to meet the needs of students, 
  2.21  employees, and members of the public.  
  2.22     Subd. 4.  [SUBSIDIES.] State agencies providing a subsidy, 
  2.23  direct or indirect, for singly occupied motor vehicle commuting 
  2.24  by a state employee, including provision of parking at below 
  2.25  local market rates, shall make available an equal or greater 
  2.26  subsidy for bicycle commuting by a state employee.
