1.1 A bill for an act 1.2 relating to crimes; eliminating misdemeanor offense of 1.3 selling toxic substances to minors; amending Minnesota 1.4 Statutes 1996, section 609.684, subdivision 4; 1.5 repealing Minnesota Statutes 1996, sections 145.406; 1.6 and 609.684, subdivision 2. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 609.684, 1.9 subdivision 4, is amended to read: 1.10 Subd. 4. [NOTICE REQUIRED.] (a) A business establishment 1.11 that offers for sale at retail any toxic substance must display 1.12 a conspicuous sign that contains the following, or substantially 1.13 similar, language: 1.14 "NOTICE 1.15It is unlawful for a person to sell glue, cement, or aerosol1.16paint containing intoxicating substances, to a person under 181.17years of age, except as provided by law. This offense is a1.18misdemeanor.It isalsoa misdemeanor for a person to use or 1.19 possess glue, cement, aerosol paint, with the intent of inducing 1.20 intoxication, excitement, or stupefaction of the central nervous 1.21 system. This use can be harmful or fatal." 1.22 (b) A business establishment may omit from the required 1.23 notice references to any toxic substance that is not offered for 1.24 sale by that business establishment. 1.25 (c) A business establishment that does not sell any toxic 1.26 substance listed in subdivision 1 other than butane or butane 2.1 lightersshall post a sign stating that it is illegal to sell2.2butane or butane lighters to anyone under the age of 18. This2.3sign shall fulfill the requirements under this subdivisionis 2.4 not required to post a notice under paragraph (a). 2.5 Sec. 2. [REPEALER.] 2.6 Minnesota Statutes 1996, sections 145.406; and 609.684, 2.7 subdivision 2, are repealed.
