  1.1                          A bill for an act 
  1.2             relating to human services; providing for county 
  1.3             agency reimbursement for services provided to American 
  1.4             Indians living on reservations; appropriating money; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 256. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [256.9981] [PAYMENTS FOR SERVICES PROVIDED TO 
  1.9   AMERICAN INDIANS WHO LIVE ON INDIAN RESERVATIONS.] 
  1.10     Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.11  section, the following terms have the meanings given them. 
  1.12     (a) "Reservation" means Indian country as defined in United 
  1.13  States Code, title 18, section 1151. 
  1.14     (b) "American Indian" means a person who: 
  1.15     (1) is a member of an Indian tribe located in Minnesota 
  1.16  that is recognized by the federal government; and 
  1.17     (2) lives on the reservation where the person is a member. 
  1.18     (c) "County agency expenditure" means the net expenditure 
  1.19  or cost incurred by a county for those benefits and services 
  1.20  specified in subdivision 2 which are incurred for, or provided 
  1.21  to, an American Indian who resides in that county.  County 
  1.22  agency expenditure includes the county's pro rata share of 
  1.23  administrative costs to provide those services. 
  1.24     Subd. 2.  [COVERED PROGRAMS AND SERVICES.] The procedures 
  1.25  in this section govern the payment of county agency expenditures 
  1.26  incurred for, or provided to, American Indians under the 
  2.1   following programs: 
  2.2      (1) apprehension, prosecution, and detention of American 
  2.3   Indians; and 
  2.4      (2) out-of-home placement costs of American Indians. 
  2.5      Subd. 3.  [PAYMENT METHODS.] The state will reimburse 
  2.6   counties for county agency expenditures.  Payment must be made 
  2.7   by the commissioner of human services to each eligible county, 
  2.8   by the last day of the month following the county expenditure. 
  2.9      Subd. 4.  [REQUIRED REPORTS.] By the 15th of each month, 
  2.10  each county eligible for reimbursement according to this section 
  2.11  must file a report with the commissioner of human services 
  2.12  detailing the expenses eligible for reimbursement incurred in 
  2.13  the previous month.  The commissioner must specify the 
  2.14  requirements for these reports. 
  2.15     Sec. 2.  [APPROPRIATION.] 
  2.16     $....... is appropriated from the general fund to the 
  2.17  commissioner of human services for purposes of section 1. 
  2.18     Sec. 3.  [EFFECTIVE DATE.] 
  2.19     Section 1 is effective for county agency expenditures 
  2.20  incurred after December 31, 1997.
