A bill for an act
relating to public safety; requiring health clubs to notify members of criminal
incidents involving child members; proposing coding for new law in Minnesota
Statutes, chapter 624.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) For the purposes of this section, the terms in this
subdivision have the meanings given them.

new text begin (b) "Child" means an individual under the age of 18.

new text begin (c) "Health club" means any corporation, partnership, unincorporated association,
nonprofit organization, or other business enterprise having the primary purpose of offering
one or more facilities for instruction, training, encouragement, or assistance in physical
fitness, in return for the payment of a fee entitling the member to the use of the facilities.

new text begin (d) "Member" has the meaning given in section 325G.23, subdivision 7.

new text begin A health club shall immediately notify its members upon the
confirmation of a criminal incident involving a child on the health club premises. The
health club shall post a sufficient number of signs on the club premises to give adequate
notice of the incident to club members entering onto or leaving the premises. Additionally,
the health club shall give notice of the incident to all members with children by e-mail
or mail delivered by the United States post office. The notice must minimally include a
general description of the criminal incident, the date of the incident, and the general
location of the incident on the health club premises.
