1.1 A bill for an act 1.2 relating to insurance; requiring certain insurers to 1.3 provide certain water or steam damage coverage; 1.4 proposing coding for new law in Minnesota Statutes, 1.5 chapter 65A. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. [65A.265] [WATER OR STEAM DAMAGE COVERAGE.] 1.8 An insurer writing homeowner's, cooperative housing, or 1.9 condominium insurance in this state shall make available 1.10 coverage for loss or damage from the discharge or overflow of 1.11 water or steam from within a plumbing, heating, air 1.12 conditioning, or automatic fire protective sprinkler system that 1.13 is not otherwise covered or is excluded from coverage by the 1.14 standard policy forms issued by the Insurance Services Office. 1.15 The coverage must include payment for tearing out and 1.16 replacing any part of the insured premises if necessary to 1.17 repair the system or appliance from which the water or steam 1.18 escaped. 1.19 The coverage may be included in the policy or as a rider or 1.20 endorsement attached to the policy. 1.21 Sec. 2. [EFFECTIVE DATE.] 1.22 Section 1 is effective the day following final enactment 1.23 and applies to policies issued or renewed on or after that date.
