A bill for an act
relating to public safety; requiring rulemaking to ensure private facilities and
farm taps are subject to the excavation notice system.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

TAPS.

new text begin (a) The commissioner of public safety shall amend Minnesota Rules, chapter 7560,
to incorporate private facilities and farm taps into the excavation notice system. The
rules must establish clear requirements and procedures, including assignment of duties
and responsibilities to excavators, land surveyors, the notification center, operators, and
any other affected persons, to ensure private facilities and farm taps are properly located
and marked prior to excavation.

new text begin (b) In adopting the rules, the commissioner shall use the expedited process under
Minnesota Statutes, section 14.389.

new text begin (c) For the purposes of this section, the definitions in Minnesota Statutes, section
216D.01, apply. To the extent any existing statutory definitions or other provisions in
Minnesota Statutes, chapter 216D, require amendments to facilitate compliance with
the requirements of paragraph (a), the commissioner of public safety shall develop and
propose suggested changes for the 2014 legislative session.
