  1.1                          A bill for an act 
  1.2             relating to juvenile justice; requiring the court to 
  1.3             order screening in specified areas before making a 
  1.4             dispositional order for out-of-home placement; 
  1.5             amending Minnesota Statutes 1998, section 260.181, 
  1.6             subdivision 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 260.181, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [CONSIDERATION OF REPORTS.] (a) Before making a 
  1.11  disposition in a case, or terminating parental rights, or 
  1.12  appointing a guardian for a child the court may consider any 
  1.13  report or recommendation made by the local social services 
  1.14  agency, probation officer, licensed child-placing agency, foster 
  1.15  parent, guardian ad litem, tribal representative, or other 
  1.16  authorized advocate for the child or child's family, a school 
  1.17  district concerning the effect on student transportation of 
  1.18  placing a child in a school district in which the child is not a 
  1.19  resident, or any other information deemed material by the court. 
  1.20     (b) If the court is to consider removing a child who is ten 
  1.21  years of age or older from the child's family residence and 
  1.22  placing the child in a licensed family foster home or 
  1.23  residential facility pursuant to the provisions in this section, 
  1.24  the court shall order screening of the child in the following 
  1.25  areas if such information has not already been presented to the 
  1.26  court: 
  2.1      (1) health; 
  2.2      (2) mental health; 
  2.3      (3) education; 
  2.4      (4) chemical dependency; and 
  2.5      (5) sexual abusive behavior. 
  2.6      (b) If the court issues a dispositional order for an 
  2.7   out-of-home placement for a child for whom screening reports 
  2.8   were ordered, all the reports shall be given to the out-of-home 
  2.9   placement provider prior to or at the time of admission unless 
  2.10  there is a compelling reason why the reports should not be given 
  2.11  to the placement agency.
