  1.1                          A bill for an act 
  1.2             relating to public safety; directing commissioner of 
  1.3             administration to temporarily transfer proceeds of 
  1.4             enhanced 911 service fee to pay for enhanced 911 
  1.5             services for cellular and other wireless 
  1.6             communications access costs accruing to state patrol; 
  1.7             amending Minnesota Statutes 1996, sections 403.113, 
  1.8             subdivision 1; and 403.13.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 403.113, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [FEE.] (a) In addition to the actual fee 
  1.13  assessed under section 403.11, each customer receiving local 
  1.14  telephone service, excluding including cellular or other nonwire 
  1.15  service, is assessed a fee to fund implementation and 
  1.16  maintenance of enhanced 911 service, including acquisition of 
  1.17  necessary equipment and the costs of the department of 
  1.18  administration to administer the program.  The actual fee 
  1.19  assessed under section 403.11 and the enhanced 911 service fee 
  1.20  must be collected as one amount and may not exceed the amount 
  1.21  specified in section 403.11, subdivision 1, paragraph (b). 
  1.22     (b) The enhanced 911 service fee must be collected and 
  1.23  deposited in the same manner as the fee in section 403.11 and 
  1.24  used solely for the purposes of paragraph (a) and subdivision 3. 
  1.25     (c) The commissioner of the department of administration, 
  1.26  in consultation with counties and 911 system users, shall 
  1.27  determine the amount of the enhanced 911 service fee and inform 
  2.1   telephone companies of the total amount of the 911 service fees 
  2.2   in the same manner as provided in section 403.11. 
  2.3      Sec. 2.  Minnesota Statutes 1996, section 403.13, is 
  2.4   amended to read: 
  2.5      403.13 [CELLULAR TELEPHONE USE.] 
  2.6      Subdivision 1.  [STATE PATROL FUNCTIONS.] The state patrol 
  2.7   division of the department of public safety shall serve as the 
  2.8   default initial answering point for cellular 911 calls within 
  2.9   the state of Minnesota.  Existing county and statutory or home 
  2.10  rule charter city 911 systems may become the initial answering 
  2.11  point for wireless enhanced 911 calls when a minimum of 80 
  2.12  percent of the calls for service received from a specific 
  2.13  cellular antenna site or antenna cell face located within the 
  2.14  requesting county or city boundaries are calls requiring a 
  2.15  primary response from that county or city.  The department of 
  2.16  public safety shall maintain records and provide them to the 
  2.17  department of administration on a quarterly and annual basis for 
  2.18  review and determination based on calls for service, 
  2.19  effectiveness, and practicality for any alterations in routing 
  2.20  cellular and other wireless 911 calls.  Any existing county or 
  2.21  city requesting the ability to answer cellular 911 calls must, 
  2.22  in addition to the above requirements, have the enhanced 911 
  2.23  equipment installed and operational prior to any routing changes 
  2.24  from a specific antenna site or antenna cell face.  
  2.25     Subd. 2.  [NOTICE TO SUBSCRIBERS.] A provider of cellular 
  2.26  telephone services in Minnesota shall notify its subscribers at 
  2.27  the time of initial subscription and four times per year 
  2.28  thereafter that a 911 emergency call made with a cellular 
  2.29  telephone is not always answered by a local public safety 
  2.30  answering point but rather is routed to a state patrol 
  2.31  dispatcher and that, accordingly, the caller must provide 
  2.32  specific information regarding the caller's location. 
  2.33     Sec. 3.  [ENHANCED 911 WIRELESS SERVICE; TEMPORARY FEE.] 
  2.34     Until July 1, 1998, in addition to the transfer provided 
  2.35  for in Minnesota Statutes 1996, section 403.11, and according to 
  2.36  Minnesota Statutes 1996, section 403.113, subdivision 1, the 
  3.1   commissioner of administration shall transfer an amount equal to 
  3.2   ten cents a month from the fee assessed under Minnesota Statutes 
  3.3   1996, section 403.113, on cellular and other nonwire access 
  3.4   services to the commissioner of public safety for the purpose of 
  3.5   offsetting the costs incurred by the state patrol division of 
  3.6   the department of public safety in integrating cellular and 
  3.7   other nonwire access services and the state patrol 911 answering 
  3.8   points into the enhanced 911 networks. 
  3.9      Sec. 4.  [EFFECTIVE DATE.] 
  3.10     Sections 1 to 3 are effective July 1, 1997.
