  1.1                          A bill for an act 
  1.2             relating to paternity; providing for paternity of 
  1.3             certain children conceived by artificial insemination 
  1.4             after death of father; amending Minnesota Statutes 
  1.5             1994, section 257.56, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 257.56, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [ARTIFICIAL INSEMINATION OF WIFE AFTER HUSBAND'S 
  1.10  DEATH.] If, under the supervision of a licensed physician, a 
  1.11  woman is impregnated artificially after her husband's death with 
  1.12  semen donated by her husband, the child is treated in law as if 
  1.13  it were the biological child of the husband, provided that: 
  1.14     (1) the husband executed a will or other document 
  1.15  expressing his intent to allow the use of his semen to 
  1.16  impregnate his wife; or 
  1.17     (2) there is other credible evidence of his intent to allow 
  1.18  the use of his semen to impregnate his wife.
