A bill for an act
relating to education; making nonpublic schools that receive state aid, materials,
services, or other publicly funded support subject to certain requirements;
proposing coding for new law in Minnesota Statutes, chapter 123B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding other law to the contrary, a nonpublic school that receives aid,
materials, services, or other publicly funded support under sections 123B.40 to 123B.48,
as a condition of receiving the aid, materials, services, or support must:

(1) provide reasonable accommodations to students, consistent with the requirements
under the Americans with Disabilities Act, Public Law 101-363;

(2) comply with the open meeting law under chapter 13 as if the nonpublic school
were a school district;

new text begin
(3) adopt a policy to prevent discrimination, harassment, and violence that complies
with section 121A.03 and an anti-intimidation and bullying policy that complies with
section 121A.0695;

(4) annually report on student enrollment and attrition, school finances, governance
and management, staffing, student and faculty demographics, and academic performance
measures, consistent with section 124D.10, subdivision 14;

(5) submit student academic performance data to the commissioner in the form and
manner required by the commissioner so that the commissioner may include the school in
the state's annual school performance report cards under section 120B.36; and

(6) comply with the Pupil Fair Dismissal Act under sections 121A.40 to 121A.575.

This section is effective the day following final enactment.
