  1.1                          A bill for an act 
  1.2             relating to traffic regulations; authorizing cities to 
  1.3             establish speed limits for streets under their 
  1.4             jurisdiction; making technical changes; amending 
  1.5             Minnesota Statutes 1998, section 169.14, subdivisions 
  1.6             2 and 5b. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 169.14, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [SPEED LIMITS.] (a) Where no special hazard 
  1.11  exists the following speeds shall be lawful, but any speeds in 
  1.12  excess of such limits shall be prima facie evidence that the 
  1.13  speed is not reasonable or prudent and that it is unlawful; 
  1.14  except that the speed limit within any municipality shall be a 
  1.15  maximum limit and any speed in excess thereof shall be unlawful: 
  1.16     (1) 30 miles per hour in an urban district, except as 
  1.17  otherwise determined under paragraph (b); 
  1.18     (2) 65 miles per hour on non-interstate freeways and 
  1.19  expressways, as defined in section 160.02, subdivision 16; 
  1.20     (3) 55 miles per hour in locations other than those 
  1.21  specified in this section; 
  1.22     (4) 70 miles per hour on Interstate highways outside the 
  1.23  limits of any urbanized area with a population of greater than 
  1.24  50,000 as defined by order of the commissioner of 
  1.25  transportation; 
  1.26     (5) 65 miles per hour on Interstate highways inside the 
  2.1   limits of any urbanized area with a population of greater than 
  2.2   50,000 as defined by order of the commissioner of 
  2.3   transportation; and 
  2.4      (6) ten miles per hour in alleys; and 
  2.5      (7) 25 miles per hour in residential roadways if adopted by 
  2.6   the road authority having jurisdiction over the residential 
  2.7   roadway alleyways.  
  2.8      (b) A statutory or home rule charter city may by ordinance 
  2.9   establish a speed limit for a street that (1) is under the 
  2.10  jurisdiction of the city, including a municipal state-aid 
  2.11  street, and (2) is either a residential roadway or is located in 
  2.12  an urban district.  A speed limit adopted by ordinance under 
  2.13  this paragraph (a), clause (7), is not effective unless the road 
  2.14  authority has erected signs designating the speed limit and 
  2.15  indicating the beginning and end of the street or residential 
  2.16  roadway on which the speed limit applies.  A speed in excess of 
  2.17  a speed limit established under this paragraph is unlawful.  
  2.18     Sec. 2.  Minnesota Statutes 1998, section 169.14, 
  2.19  subdivision 5b, is amended to read: 
  2.20     Subd. 5b.  [SEGMENT IN URBAN DISTRICT OF TOWN.] When any 
  2.21  segment of at least a quarter-mile in distance of any city 
  2.22  street, municipal state aid street or town road on which a speed 
  2.23  limit in excess of 30 miles per hour has been established 
  2.24  pursuant to an engineering and traffic investigation by the 
  2.25  commissioner meets the definition of "urban district" as defined 
  2.26  in section 169.01, subdivision 59, the governing body of the 
  2.27  city or town board may by resolution declare the segment to be 
  2.28  an urban district and may establish on the segment the speed 
  2.29  limit for urban districts prescribed in subdivision 2, paragraph 
  2.30  (a).  The speed limit so established shall be effective upon the 
  2.31  erection of appropriate signs designating the speed and 
  2.32  indicating the beginning and end of the segment on which the 
  2.33  speed limit is established, and any speed in excess of such 
  2.34  posted limits shall be unlawful.  A copy of the resolution shall 
  2.35  be transmitted to the commissioner at least ten days prior to 
  2.36  the erection of the signs.
