  1.1                          A bill for an act 
  1.2             relating to crime prevention; changing the membership 
  1.3             of the peace officer standards and training board; 
  1.4             directing that certain institutions implement programs 
  1.5             to allow completion of core law enforcement courses in 
  1.6             two quarters; requiring representation of higher 
  1.7             education on the board's training committee; 
  1.8             appropriating money; amending Minnesota Statutes 1994, 
  1.9             section 626.841; proposing coding for new law in 
  1.10            Minnesota Statutes, chapter 626. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1994, section 626.841, is 
  1.13  amended to read: 
  1.14     626.841 [BOARD; MEMBERS.] 
  1.15     The board of peace officer standards and training shall be 
  1.16  composed of the following 15 members: 
  1.17     (a) Two members to be appointed by the governor from among 
  1.18  the county sheriffs in Minnesota; 
  1.19     (b) Four members to be appointed by the governor from among 
  1.20  peace officers in Minnesota municipalities, at least two of whom 
  1.21  shall be chiefs of police; 
  1.22     (c) Two members to be appointed by the governor from among 
  1.23  peace officers, at least one of whom shall be a member of the 
  1.24  Minnesota state patrol association; 
  1.25     (d) The superintendent of the Minnesota bureau of criminal 
  1.26  apprehension or a designee; 
  1.27     (e) Two members appointed by the governor experienced in 
  1.28  law enforcement at a local, state, or federal level from among 
  2.1   peace officers, or former peace officers, who are not currently 
  2.2   employed as on a full-time basis in a professional peace 
  2.3   officers officer education program; 
  2.4      (f) Two members to be appointed by the governor, one member 
  2.5   to be appointed from among administrators of Minnesota colleges 
  2.6   or universities that offer professional peace officer education, 
  2.7   and one member to be appointed from among the elected city 
  2.8   officials in statutory or home rule charter cities of under 
  2.9   5,000 population outside the metropolitan area, as defined in 
  2.10  section 473.121, subdivision 2; 
  2.11     (g) Two members appointed by the governor from among the 
  2.12  general public.  
  2.13     A chair shall be appointed by the governor from among the 
  2.14  members.  In making appointments the governor shall strive to 
  2.15  achieve representation from among the geographic areas of the 
  2.16  state. 
  2.17     Sec. 2.  [626.8555] [PEACE OFFICER EDUCATION PROGRAMS.] 
  2.18     By October 15, 1995, Metropolitan State University and 
  2.19  Minneapolis Community College shall modify the delivery of the 
  2.20  licensing courses in their law enforcement programs so that 
  2.21  students may complete core law enforcement courses in two 
  2.22  consecutive quarters during the regular academic year.  Priority 
  2.23  placement must be granted to students who have received a 
  2.24  conditional offer of employment and have been enrolled by a law 
  2.25  enforcement agency which has met the board's hiring standards 
  2.26  for peace officers. 
  2.27     State and local law enforcement agencies, including the 
  2.28  Minnesota department of public safety, shall contract only with 
  2.29  Metropolitan State University and Minneapolis Community College 
  2.30  to provide peace officers with law enforcement courses and 
  2.31  consult with these institutions to establish admission 
  2.32  procedures. 
  2.33     Sec. 3.  [TRAINING COMMITTEE MEMBERSHIP.] 
  2.34     At least one person shall be appointed to the board's 
  2.35  training committee from among administrators of Minnesota 
  2.36  colleges or universities that offer professional peace officer 
  3.1   education. 
  3.2      Sec. 4.  [APPROPRIATION.] 
  3.3      The sums shown in the columns marked "APPROPRIATIONS" are 
  3.4   appropriated from the peace officers training account in the 
  3.5   special revenue fund to the board of peace officer standards and 
  3.6   training for the purposes specified, and are available for the 
  3.7   fiscal years indicated for each purpose.  The figures "1996" and 
  3.8   "1997" mean that the appropriation or appropriations listed 
  3.9   under them are available for the year ending June 30, 1996, or 
  3.10  June 30, 1997, respectively.

  3.17  Any funds deposited into the peace 
  3.18  officers training account in the 
  3.19  special revenue fund in fiscal year 
  3.20  1996 or fiscal year 1997 in excess of 
  3.21  $4,200,000 must be transferred and 
  3.22  credited to the general fund.  The 
  3.23  amounts that may be spent from the 
  3.24  appropriation for each program are more 
  3.25  specifically described below. 
  3.26  Of this appropriation, $140,000 the 
  3.27  first year and $155,000 the second year 
  3.28  are for the development of an advanced 
  3.29  law enforcement degree. 
  3.30  Of this appropriation, $328,000 the 
  3.31  first year and $328,000 the second year 
  3.32  shall be made available to law 
  3.33  enforcement agencies to pay educational 
  3.34  expenses of students who have been 
  3.35  given conditional offers of employment 
  3.36  by the agency and who are enrolled in 
  3.37  the licensing core of a professional 
  3.38  peace officer education program.  No 
  3.39  more than $5,000 may be expended on a 
  3.40  single student. 
  3.41  Of this appropriation, $2,700,000 the 
  3.42  first year and $2,848,000 the second 
  3.43  year are to reimburse local law 
  3.44  enforcement for the cost of 
  3.45  administering board-approved continuing 
  3.46  education to peace officers.  The board 
  3.47  shall provide a minimum of $400 per 
  3.48  peace officer in 1996 and $425 per 
  3.49  peace officer in 1997. 
  3.50  The remaining money may be spent on 
  3.51  budget initiatives. 
  3.52     Sec. 5.  [EFFECTIVE DATE.] 
  3.53     Sections 1, 2, and 3 are effective August 1, 1995, and 
  4.1   apply to appointments made and contracts entered into on or 
  4.2   after that date.
