  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing private sale of 
  1.3             certain state lands to wild rice lessees. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [SALE OF STATE LANDS TO WILD RICE LESSEES.] 
  1.6      (a) Notwithstanding Minnesota Statutes, sections 84A.56, 
  1.7   89.021, 89.27, and 92.45, and the public sale provisions of 
  1.8   Minnesota Statutes, sections 94.10, 282.14, and 282.221, the 
  1.9   commissioner of natural resources may sell by private sale to 
  1.10  the wild rice lessees under leases authorized in Minnesota 
  1.11  Statutes, section 92.501, the acquired, consolidated 
  1.12  conservation and Volstead area lands described in paragraph (b) 
  1.13  under the remaining sale provisions in Minnesota Statutes, 
  1.14  sections 94.10 and 282.14 to 282.226.  The affected counties 
  1.15  must approve these sales for consolidated conservation and 
  1.16  Volstead area lands. 
  1.17     (b) The land that may be sold is described as: 
  1.18     (1) The Southeast Quarter of Section 10; that part of the 
  1.19  West Half of the Southwest Quarter of Section 11 lying westerly 
  1.20  of the west bank of the Tamarac River; the Southeast Quarter of 
  1.21  the Northwest Quarter and that part of the Northeast Quarter 
  1.22  lying westerly of the west bank of the Tamarac River of Section 
  1.23  15; the Northwest Quarter of the Northwest Quarter and the West 
  1.24  160 feet of the Northeast Quarter of the Northwest Quarter of 
  2.1   Section 16, Township 154 North, Range 30 West, Beltrami county, 
  2.2   Minnesota, to be sold to Raymond Berger; 
  2.3      (2) The Northwest Quarter of the Southwest Quarter, Section 
  2.4   11, Township 152 North, Range 32 West, Beltrami county, 
  2.5   Minnesota, to be sold to Edward Mohs; 
  2.6      (3) The North Half of the Southwest Quarter, the North Half 
  2.7   of the Southwest Quarter of the Southwest Quarter, and the North 
  2.8   Half of the Northwest Quarter of the Southeast Quarter of 
  2.9   Section 14, Township 152 North, Range 32 West; the Northeast 
  2.10  Quarter of the Southwest Quarter of Section 19, Township 155 
  2.11  North, Range 31 West; and Government Lot 1, the East 330 feet of 
  2.12  Government Lot 2, and the North 330 feet of Government Lot 6, 
  2.13  Section 25, Township 155 North, Range 32 West, Beltrami county, 
  2.14  Minnesota, to be sold to John Florhaug; 
  2.15     (4) The South 330 feet of Government Lot 4 and the south 
  2.16  330 feet of the Southeast Quarter of the Southwest Quarter of 
  2.17  Section 18; Government Lots 1, 2, 3 and 4, the East Half of the 
  2.18  Northwest Quarter, the East Half of the Southwest Quarter, the 
  2.19  Southwest Quarter of the Southeast Quarter, the West 200 feet of 
  2.20  the Southeast Quarter of the Southeast Quarter; and the West 900 
  2.21  feet of the South 700 feet of the Northwest Quarter of the 
  2.22  Southeast Quarter of Section 19; and the North Half of the 
  2.23  Northeast Quarter of Section 30, Township 154 North, Range 29 
  2.24  West, Koochiching county, Minnesota, to be sold to Michael 
  2.25  Nistler; 
  2.26     (5) The Northwest Quarter of the Northeast Quarter and the 
  2.27  North 330 feet of the Southwest Quarter of the Northeast Quarter 
  2.28  of Section 22, Township 150 North, Range 39 West, Polk county, 
  2.29  Minnesota, to be sold to Brian Holmberg; 
  2.30     (6) The Southeast Quarter of the Northwest Quarter; that 
  2.31  part of the Southwest Quarter of the Northwest Quarter lying 
  2.32  east of County Road No. 24; that part of the Northwest Quarter 
  2.33  of the Northwest Quarter lying south of the south bank of State 
  2.34  Ditch No. 63 and east of County Road No. 24; and that part of 
  2.35  the North Half of the Northeast Quarter and the Northeast 
  2.36  Quarter of the Northwest Quarter lying south of the south bank 
  3.1   of State Ditch No. 63; all in Section 27, Township 48 North, 
  3.2   Range 27 West, Aitkin county, Minnesota, to be sold to Thomas 
  3.3   Godward; 
  3.4      (7) The Northeast Quarter of Section 35, Township 48 North, 
  3.5   Range 27 West, Aitkin county, Minnesota, to be sold to the 
  3.6   Manomin Development Corporation; 
  3.7      (8) The Northwest Quarter of the Northeast Quarter of 
  3.8   Section 8, Township 48 North, Range 26 West, Aitkin county, 
  3.9   Minnesota, to be sold to Harold Kosbau; 
  3.10     (9) The West Half of the Northeast Quarter, the Southeast 
  3.11  Quarter of the Northeast Quarter, and the South 660 feet of the 
  3.12  Northeast Quarter of the Northeast Quarter of Section 10; and 
  3.13  the West 330 feet of the Southwest Quarter of the Northwest 
  3.14  Quarter of Section 11; Township 154 North, Range 30 West, 
  3.15  Beltrami county, Minnesota, to be sold to K.D. Wild Rice; and 
  3.16     (10) The South 660 feet of the Northwest Quarter of the 
  3.17  Northwest Quarter, the South 660 feet of the West 660 feet of 
  3.18  the Northeast Quarter of the Northwest Quarter, the North 660 
  3.19  feet of the West 660 feet of the Southeast Quarter of the 
  3.20  Northwest Quarter, and the South Half of the Northeast Quarter 
  3.21  of the Southwest Quarter of Section 21, Township 154 North, 
  3.22  Range 30 West, Beltrami county, Minnesota, to be sold to K.D. 
  3.23  Wild Rice. 
  3.24     (c) The conveyances shall be in a form approved by the 
  3.25  attorney general.  In determining the value of the described 
  3.26  lands, no improvements paid for by the lessee shall be added to 
  3.27  the value of the land. 
  3.28     Sec. 2.  [EFFECTIVE DATE.] 
  3.29     Section 1 is effective the day following final enactment.
