  1.1                          A bill for an act 
  1.2             relating to retirement; public employees police and 
  1.3             fire plan; recrediting service credit for certain 
  1.4             University of Minnesota police officers with prior 
  1.5             Duluth police department employment. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PUBLIC EMPLOYEES POLICE AND FIRE FUND; 
  1.8   RECREDITING OF SERVICE CREDIT.] 
  1.9      (a) Notwithstanding any provision of Minnesota Statutes, 
  1.10  section 353A.10, subdivision 1, to the contrary, an eligible 
  1.11  person described in paragraph (b) is entitled to have prior 
  1.12  service credit in the Duluth police relief association credited 
  1.13  by the public employees police and fire plan upon payment to the 
  1.14  public employees police and fire fund of the amount calculated 
  1.15  under paragraph (c). 
  1.16     (b) An eligible person is a person who: 
  1.17     (1) is currently employed as a police officer by the 
  1.18  University of Minnesota, Duluth; 
  1.19     (2) was employed by the city of Duluth as a patrol officer 
  1.20  from September 19, 1974, to September 16, 1976, under the 
  1.21  federal Comprehensive Employment and Training Act; 
  1.22     (3) was covered by the Duluth police relief association 
  1.23  during employment by the Duluth police department, made 
  1.24  contributions to that pension fund, but did not receive a refund 
  1.25  of those contributions upon the termination of employment; and 
  2.1      (4) was employed by the University of Minnesota, Duluth, 
  2.2   police department since September 16, 1976, and is covered by 
  2.3   the public employees police and fire plan by virtue of that 
  2.4   employment. 
  2.5      (c) The payment amount is the full actuarial value payment 
  2.6   amount determined under Minnesota Statutes, section 356.55.  The 
  2.7   payment amount may be made by either the city of Duluth or by 
  2.8   the University of Minnesota.  Payment by the city of Duluth may 
  2.9   be made by a transfer from the joint Duluth police and fire 
  2.10  consolidation account.  Authority to make this payment expires 
  2.11  on July 1, 2001. 
  2.12     (d) Service credit for the period September 19, 1974, to 
  2.13  September 16, 1976, must be granted in the public employees 
  2.14  police and fire plan upon receipt of the payment specified in 
  2.15  paragraph (c). 
  2.16     (e) The executive director of the public employees 
  2.17  retirement association may require adequate documentation from 
  2.18  the eligible person, the city of Duluth, or the University of 
  2.19  Minnesota, Duluth, of the applicability of any eligibility 
  2.20  requirements. 
  2.21     Sec. 2.  [EFFECTIVE DATE.] 
  2.22     Section 1 is effective on the day following final enactment.
