  1.1                          A bill for an act 
  1.2             relating to municipalities; requiring a moratorium on 
  1.3             use permits for large retail stores; requiring a 
  1.4             report. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [MORATORIUM.] 
  1.7      (a) Notwithstanding other law, a municipality must not 
  1.8   receive, process, or approve an application for a use permit, or 
  1.9   amendment to a use permit for a retail store containing 100,000 
  1.10  square feet or more. 
  1.11     (b) Notwithstanding other law, a municipality must not 
  1.12  process, continue to process, approve, or take any further 
  1.13  action on any use permit or amendment to a use permit for retail 
  1.14  stores of 100,000 square feet or more. 
  1.15     (c) The moratorium imposed by paragraphs (a) and (b) is in 
  1.16  effect through February 28, 2005. 
  1.17     (d) A municipality under this section means a statutory or 
  1.18  home rule charter city, a town, or a county. 
  1.19     Sec. 2.  [REPORT.] 
  1.20     Before January 1, 2005, the commissioner of trade and 
  1.21  economic development must report, with findings and 
  1.22  recommendations, to the legislative committees with jurisdiction 
  1.23  of the subject matter on the commissioner's examination of the 
  1.24  impact of large retail stores, including, but not limited to, 
  1.25  the impacts on public facilities and surrounding lands and 
  2.1   improvements. 
  2.2      Sec. 3.  [EFFECTIVE DATE.] 
  2.3      Section 1 and 2 are effective the day after their final 
  2.4   enactment.
