  1.1                          A bill for an act 
  1.2             relating to health occupations; modifying the 
  1.3             temporary practice requirements for alcohol and drug 
  1.4             counselors; amending Minnesota Statutes 2002, section 
  1.5             148C.04, subdivision 6.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 148C.04, 
  1.8   subdivision 6, is amended to read: 
  1.9      Subd. 6.  [TEMPORARY PRACTICE REQUIREMENTS.] (a) A person 
  1.10  may temporarily practice alcohol and drug counseling prior to 
  1.11  being licensed under this chapter if the person: 
  1.12     (1) either: 
  1.13     (i) meets the associate degree education and practicum 
  1.14  requirements of subdivision 3, clause (1); 
  1.15     (ii) meets the bachelor's degree education and practicum 
  1.16  requirements of subdivision 4, clause (1), item (i); or 
  1.17     (iii) submits verification of a current and unrestricted 
  1.18  credential for the practice of alcohol and drug counseling from 
  1.19  a national certification body or a certification or licensing 
  1.20  body from another state, United States territory, or federally 
  1.21  recognized tribal authority; 
  1.22     (2) requests, in writing, temporary practice status with 
  1.23  the commissioner on an application form according to section 
  1.24  148C.0351, which includes the nonrefundable license fee and an 
  1.25  affirmation by the person's supervisor, as defined in paragraph 
  2.1   (b), clause (1), and which is signed and dated by the person and 
  2.2   the person's supervisor; 
  2.3      (3) has not been disqualified to practice temporarily on 
  2.4   the basis of a background investigation under section 148C.09, 
  2.5   subdivision 1a; and 
  2.6      (4) has been notified in writing by the commissioner that 
  2.7   the person is qualified to practice under this subdivision. 
  2.8      (b) A person practicing under this subdivision: 
  2.9      (1) may practice only in a program licensed by the 
  2.10  department of human services and under the direct, on-site 
  2.11  supervision of a person who is licensed under this chapter and 
  2.12  employed in that licensed program; 
  2.13     (2) is subject to the rules of professional conduct set by 
  2.14  rule; and 
  2.15     (3) is not subject to the continuing education requirements 
  2.16  of section 148C.05. 
  2.17     (c) A person practicing under this subdivision may not use 
  2.18  with the public any title or description stating or implying 
  2.19  that the person is licensed to engage in the practice of alcohol 
  2.20  and drug counseling. 
  2.21     (d) The temporary status of a person applying for temporary 
  2.22  practice under this subdivision expires on the date the 
  2.23  commissioner grants or denies licensing. 
  2.24     Sec. 2.  [EFFECTIVE DATE.] 
  2.25     Section 1 is effective the day following final enactment.
