  1.1                          A bill for an act 
  1.2             relating to civil proceedings; expanding parties 
  1.3             eligible for fees and expenses in certain proceedings 
  1.4             involving the state; amending Minnesota Statutes 1994, 
  1.5             section 15.471, subdivision 6. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 15.471, 
  1.8   subdivision 6, is amended to read: 
  1.9      Subd. 6.  [PARTY.] (a) Except as modified by paragraph (b), 
  1.10  "party" means a person named or admitted as a party, or seeking 
  1.11  and entitled to be admitted as a party, in a court action or 
  1.12  contested case proceeding, or a person admitted by an 
  1.13  administrative law judge for limited purposes, and who is: 
  1.14     (1) an unincorporated business, partnership, corporation, 
  1.15  association, or organization, having not more than 50 200 
  1.16  employees at the time the civil action was filed or the 
  1.17  contested case proceeding was initiated; and 
  1.18     (2) an unincorporated business, partnership, corporation, 
  1.19  association, or organization whose annual revenues did not 
  1.20  exceed $4,000,000 $75,000,000 at the time the civil action was 
  1.21  filed or the contested case proceeding was initiated. 
  1.22     (b) "Party" also includes a partner, officer, shareholder, 
  1.23  member, or owner of an entity described in paragraph (a), 
  1.24  clauses (1) and (2). 
  1.25     (c) "Party" does not include a person providing services 
  2.1   pursuant to licensure or reimbursement on a cost basis by the 
  2.2   department of health or the department of human services, when 
  2.3   that person is named or admitted or seeking to be admitted as a 
  2.4   party in a matter which involves the licensing or reimbursement 
  2.5   rates, procedures, or methodology applicable to those services.
