1.1 A bill for an act 1.2 relating to education; modifying the cooperative 1.3 secondary facilities program; authorizing a 1.4 cooperative secondary facilities grant; authorizing 1.5 the sale of bonds; appropriating money; amending 1.6 Minnesota Statutes 1994, section 124.493, by adding a 1.7 subdivision. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1994, section 124.493, is 1.10 amended by adding a subdivision to read: 1.11 Subd. 4. [CONSOLIDATION.] As an alternative to proceeding 1.12 through the cooperating and combination process established in 1.13 subdivision 3, a group of districts that receives a cooperative 1.14 secondary facility grant after May 1, 1991, may initiate 1.15 consolidation proceedings under section 122.23 no later than 1.16 four years after a grant is awarded under subdivision 1. 1.17 Sec. 2. [COOPERATIVE SECONDARY FACILITY GRANT.] 1.18 Notwithstanding Minnesota Statutes, sections 124.491 to 1.19 124.494, the commissioner of education shall award a cooperative 1.20 secondary facilities grant of $5,000,000 according to Minnesota 1.21 Statutes, section 124.493, subdivision 1, and a grant of 1.22 $1,000,000 according to Minnesota Statutes, section 124.494, 1.23 subdivision 4a, to a group of school districts consisting of 1.24 independent school district Nos. 328, Sioux Valley; 330, Heron 1.25 Lake-Okabena; 513, Brewster; and 516, Round Lake. The group of 1.26 districts must enter into a joint powers agreement and must 2.1 comply with Minnesota Statutes, section 124.494, subdivision 6. 2.2 Sec. 3. [APPROPRIATION.] 2.3 $6,000,000 is appropriated from the state bond fund to the 2.4 commissioner of education to acquire or better public lands and 2.5 buildings and to make other improvements of a capital nature as 2.6 specified in section 2. 2.7 Sec. 4. [BOND SALE AUTHORIZATION.] 2.8 To provide the money appropriated in section 3 from the 2.9 bond proceeds fund, the commissioner of finance, upon request of 2.10 the governor, shall sell and issue bonds of the state in the 2.11 amount up to $6,000,000 in the manner, upon the terms, and with 2.12 the effect prescribed by Minnesota Statutes, sections 16A.631 to 2.13 16A.675, and by the Minnesota Constitution, article XI, sections 2.14 4 to 7. 2.15 Sec. 5. [EFFECTIVE DATE.] 2.16 Sections 1 to 4 are effective the day following final 2.17 enactment.
