  1.1                          A bill for an act 
  1.2             relating to state government; providing for the 
  1.3             governor to appoint the executive secretary of the 
  1.4             board of electricity; amending Minnesota Statutes 
  1.5             2002, section 326.241, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 326.241, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [POWERS.] The governor shall appoint the 
  1.10  executive secretary of the board, who serves at the pleasure of 
  1.11  the governor in the unclassified service.  The board, or the 
  1.12  complaint committee on behalf of the board where authorized by 
  1.13  law, shall have power to: 
  1.14     (1) Elect its own officers. 
  1.15     (2) Engage and fix the compensation of inspectors, and hire 
  1.16  employees other than the executive secretary.  The salary 
  1.17  compensation of the executive secretary shall be established 
  1.18  pursuant to chapter 43A.  All agents and employees other 
  1.19  than the executive secretary and contract inspectors shall be in 
  1.20  the classified service and shall be compensated pursuant to 
  1.21  chapter 43A.  All inspectors shall hold licenses as master or 
  1.22  journeyman electricians under section 326.242, subdivision 1(1) 
  1.23  or 2(1), and shall give bond in an amount fixed by the board, 
  1.24  conditioned upon the faithful performance of their duties. 
  1.25     (3) Pay such other expenses as it may deem necessary in the 
  2.1   performance of its duties, including rent, supplies, and such 
  2.2   like. 
  2.3      (4) Enforce the provisions of sections 326.241 to 326.248, 
  2.4   and provide, upon request, such additional voluntary inspections 
  2.5   and reviews as it may deem appropriate. 
  2.6      (5) Issue, renew, refuse to renew, suspend, temporarily 
  2.7   suspend, and revoke licenses, censure licensees, assess civil 
  2.8   penalties, issue cease and desist orders, and seek injunctive 
  2.9   relief and civil penalties in court as authorized by section 
  2.10  326.242 and other provisions of Minnesota law. 
  2.11     (6) Adopt reasonable rules to carry out its duties under 
  2.12  sections 326.241 to 326.248 and to provide for the amount and 
  2.13  collection of fees for inspection and other services.  All rules 
  2.14  shall be adopted in accordance with chapter 14. 
  2.15     Sec. 2.  [EFFECTIVE DATE.] 
  2.16     Section 1 is effective the day following final enactment.
