1.1 A bill for an act 1.2 relating to occupational safety and health; providing 1.3 that certain notices are filed when placed in the 1.4 United States mail; amending Minnesota Statutes 1996, 1.5 section 182.661, subdivision 3b. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1996, section 182.661, 1.8 subdivision 3b, is amended to read: 1.9 Subd. 3b. [SERVICE OF NOTICES.] The contesting party shall 1.10 serve a copy of the notice of contest and notice to employees, 1.11 on forms provided by the commissioner, upon unrepresented 1.12 affected employees and authorized employee representatives on or 1.13 before the date the notice of contest is filed with the 1.14 commissioner. For purposes of this section,a document is1.15considered filed upon receipt by the commissionerfiling may be 1.16 accomplished by United States mail addressed to the 1.17 commissioner. Filing is timely if the document is deposited in 1.18 the United States mail and postmarked within the time fixed for 1.19 filing or otherwise timely received by the commissioner. 1.20 Sec. 2. [APPLICABILITY; EFFECTIVE DATE.] 1.21 Section 1 is effective August 1, 1997, and applies to 1.22 enforcement proceedings commenced on or after that date.
