1.1 A bill for an act 1.2 removing a limitation for regional library basic 1.3 system support grants; amending Minnesota Statutes 1.4 2002, section 134.201, subdivision 5; repealing 1.5 Minnesota Statutes 2002, section 134.34, subdivision 4. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 134.201, 1.8 subdivision 5, is amended to read: 1.9 Subd. 5. [GENERAL LEVY AUTHORITY.] The board may levy for 1.10 operation of public library service. This levy shall replace 1.11 levies for operation of public library service by cities and 1.12 counties authorized in section 134.07. The amount levied shall 1.13 be spread on the net tax capacity of all taxable property in the 1.14 district at a uniform tax rate. 1.15(a)The maximum amount that may be levied by a board under 1.16 this section isthe greater of: 1.17(1)the statewide average local support per capita for 1.18 public library services for the most recent reporting period 1.19 available, as certified by the commissioner of children, 1.20 families, and learning, multiplied by the population of the 1.21 district according to the most recent estimate of the state 1.22 demographer or the metropolitan council; or1.23(2) the total amount provided by participating counties and1.24cities under section 134.34, subdivision 4, during the year1.25preceding the first year of operation.2.1(b) For its first year of operation, the board shall levy2.2an amount not less than the total dollar amount provided by2.3participating cities and counties during the preceding year2.4under section 134.34, subdivision 4. 2.5 [EFFECTIVE DATE.] This section is effective for taxes 2.6 payable in 2004 and later. 2.7 Sec. 2. [REPEALER.] 2.8 Minnesota Statutes 2002, section 134.34, subdivision 4, is 2.9 repealed. 2.10 [EFFECTIVE DATE.] This section is effective for grants 2.11 distributed in 2004 and later.
