  1.1                          A bill for an act 
  1.2             relating to education finance; authorizing an increase 
  1.3             in referendum authority without an election in certain 
  1.4             circumstances; amending Minnesota Statutes 2000, 
  1.5             section 126C.17, by adding a subdivision.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 126C.17, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 9a.  [REFERENDUM REVENUE INCREASES.] Notwithstanding 
  1.10  subdivision 9, the school board of a district that has passed a 
  1.11  referendum, but has authority less than the referendum 
  1.12  equalization allowance specified in subdivision 5, may increase 
  1.13  its authority to the amount of the referendum equalization 
  1.14  allowance for that year by adopting a written resolution stating 
  1.15  the amount of referendum revenue authority.  A district that 
  1.16  raises its referendum revenue authority under this subdivision 
  1.17  must notify the department of children, families, and learning 
  1.18  of its new referendum revenue allowance within 30 days of the 
  1.19  board's action.
