  1.1                          A bill for an act 
  1.2             relating to crime prevention; requiring the 
  1.3             commissioner of corrections to submit recommendations 
  1.4             to the legislature regarding the impact of entering 
  1.5             into the updated interstate compact on adult 
  1.6             offenders; requiring the commissioner to develop a 
  1.7             plan to handle interstate transfers of adult offenders.
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [FINDINGS.] 
  1.10     The legislature finds that entering into the updated 
  1.11  interstate compact on adult offenders, as proposed by the 
  1.12  council of state governments, is of vital importance to the 
  1.13  safety of the people of Minnesota.  In the interest of public 
  1.14  safety, the legislature needs to be fully informed of the 
  1.15  advantages and disadvantages of entering into the compact and 
  1.16  implementing it in Minnesota.  The commissioner of corrections 
  1.17  is charged with the duty to develop and implement policies 
  1.18  regarding offenders on probation or supervised release that 
  1.19  protect the best interests of the public.  The commissioner of 
  1.20  corrections is in the best position to fully inform the 
  1.21  legislature of the impact of entering into, or not entering 
  1.22  into, the compact and to analyze whether the state should give 
  1.23  its full support and cooperation to this important venture. 
  1.24     Sec. 2.  [LEGISLATIVE RECOMMENDATIONS; STATE POLICY PLAN.] 
  1.25     By December 1, 2001, the commissioner of corrections must 
  1.26  submit legislative recommendations to the chairs and ranking 
  2.1   minority members of the house and senate committees having 
  2.2   jurisdiction over crime prevention and judiciary finance issues 
  2.3   regarding the impact of entering into, or not entering into, the 
  2.4   updated interstate compact on adult offenders, as proposed by 
  2.5   the council of state governments.  The commissioner must consult 
  2.6   with other professionals in the corrections field and must 
  2.7   consult with states that both have and have not entered into the 
  2.8   compact.  The commissioner must develop a plan for state policy 
  2.9   in regard to handling interstate transfers of adult offenders.  
  2.10  The commissioner must be prepared to act on and implement the 
  2.11  recommendations and plan in 2002.  In developing the legislative 
  2.12  recommendations and state policy plan, the commissioner must 
  2.13  consider fiscal impacts.  Any costs associated with developing 
  2.14  the legislative recommendations and state policy plan under this 
  2.15  section must be absorbed within the commissioner's current 
  2.16  budget.
