1.1 A bill for an act 1.2 relating to retirement; governmental employees in 1.3 general; establishing a normal retirement age of 65 1.4 years; amending Minnesota Statutes 1994, sections 1.5 352.01, subdivision 25; 353.01, subdivision 37; 1.6 354.05, subdivision 38; and 354A.011, subdivision 15a; 1.7 repealing Minnesota Statutes 1994, section 356.82. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1994, section 352.01, 1.10 subdivision 25, is amended to read: 1.11 Subd. 25. [NORMAL RETIREMENT AGE.] "Normal retirement age" 1.12 means age 65for a person who first became a covered employee or1.13a member of a pension fund listed in section 356.30, subdivision1.143, before July 1, 1989. For a person who first becomes a1.15covered employee after June 30, 1989, normal retirement age1.16means the higher of age 65 or "retirement age," as defined in1.17United States Code, title 42, section 416(l), as amended. 1.18 Sec. 2. Minnesota Statutes 1994, section 353.01, 1.19 subdivision 37, is amended to read: 1.20 Subd. 37. [NORMAL RETIREMENT AGE.] "Normal retirement age" 1.21 means age 65for a person who first became a public employee or1.22a member of a pension fund listed in section 356.30, subdivision1.233, before July 1, 1989. For a person who first becomes a public1.24employee after June 30, 1989, "normal retirement age" means the1.25higher of age 65 or "retirement age," as defined in United1.26States Code, title 42, section 416(l), as amended. 2.1 Sec. 3. Minnesota Statutes 1994, section 354.05, 2.2 subdivision 38, is amended to read: 2.3 Subd. 38. [NORMAL RETIREMENT AGE.] "Normal retirement age" 2.4 means age 65 for aperson who first became amember of thefund2.5or a member of a pension fund listed in section 356.30,2.6subdivision 3, before July 1, 1989. For a person who first2.7becomes a member of the fund after June 30, 1989, normal2.8retirement age means the higher of age 65 or "retirement age,"2.9as defined in United States Code, title 42, section 416(l), as2.10amendedassociation. 2.11 Sec. 4. Minnesota Statutes 1994, section 354A.011, 2.12 subdivision 15a, is amended to read: 2.13 Subd. 15a. [NORMAL RETIREMENT AGE.] "Normal retirement 2.14 age" means age 65 for a person whofirst becameis a member of 2.15 the coordinated program of the Minneapolis or St. Paul teachers 2.16 retirement fund association or the new law coordinated program 2.17 of the Duluth teachers retirement fund associationor a member2.18of a pension fund listed in section 356.30, subdivision 3,2.19before July 1, 1989. For a person who first became a member of2.20the coordinated program of the Minneapolis or St. Paul teachers2.21retirement fund association or the new law coordinated program2.22of the Duluth teachers retirement fund association after June2.2330, 1989, normal retirement age means the higher of age 65 or2.24retirement age, as defined in United States Code, title 42,2.25section 416(l), as amended. For a person who is a member of the 2.26 basic program of the Minneapolis or St. Paul teachers retirement 2.27 fund association or the old law coordinated program of the 2.28 Duluth teachers retirement fund association, normal retirement 2.29 age means the age at which a teacher becomes eligible for a 2.30 normal retirement annuity computed upon meeting the age and 2.31 service requirements specified in the applicable provisions of 2.32 the articles of incorporation or bylaws of the respective 2.33 teachers retirement fund association. 2.34 Sec. 5. [REPEALER.] 2.35 Minnesota Statutes 1994, section 356.82, is repealed. 2.36 Sec. 6. [EFFECTIVE DATE.] 3.1 Sections 1 to 5 are effective the day after final enactment.
