  1.1                          A bill for an act 
  1.2             relating to the environment; providing for a program 
  1.3             to replace mercury manometers on dairy farms; 
  1.4             appropriating money; amending Minnesota Statutes 1996, 
  1.5             sections 115A.932, subdivision 1; and 116.92, by 
  1.6             adding a subdivision; proposing coding for new law in 
  1.7             Minnesota Statutes, chapter 17.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [17.861] [REPLACEMENT OF MERCURY MANOMETERS.] 
  1.10     The commissioner, in cooperation with the pollution control 
  1.11  agency, the office of environmental assistance, dairy equipment 
  1.12  manufacturers and suppliers, and other interested parties, shall 
  1.13  develop a program to replace all mercury manometers in use on 
  1.14  dairy farms with nonmercury manometers and to arrange for the 
  1.15  acceptance, disposal, and recycling of the mercury, apparatus, 
  1.16  and manometers at no cost to the dairy farmer.  The mercury, 
  1.17  manometers, and apparatus shall be managed in accordance with 
  1.18  sections 115A.932 and 116.92. 
  1.19     Sec. 2.  Minnesota Statutes 1996, section 115A.932, 
  1.20  subdivision 1, is amended to read: 
  1.21     Subdivision 1.  [PROHIBITIONS.] (a) A person may not place 
  1.22  mercury or a thermostat, thermometer, electric switch, 
  1.23  appliance, gauge, or medical or scientific instrument from which 
  1.24  the mercury has not been removed for reuse or recycling: 
  1.25     (1) in solid waste; or 
  1.26     (2) in a wastewater disposal system. 
  2.1      (b) A person may not knowingly place mercury or a 
  2.2   thermostat, thermometer, electric switch, appliance, gauge, or 
  2.3   medical or scientific instrument from which the mercury has not 
  2.4   been removed for reuse or recycling: 
  2.5      (1) in a solid waste processing facility; or 
  2.6      (2) in a solid waste disposal facility, as defined in 
  2.7   section 115.01, subdivision 4. 
  2.8      (c) A person may not knowingly place a fluorescent or high 
  2.9   intensity discharge lamp: 
  2.10     (1) in solid waste; or 
  2.11     (2) in a solid waste facility, except a household hazardous 
  2.12  waste collection or recycling facility. 
  2.13     This paragraph does not apply to waste lamps generated by 
  2.14  households until August 1, 1994. 
  2.15     Sec. 3.  Minnesota Statutes 1996, section 116.92, is 
  2.16  amended by adding a subdivision to read: 
  2.17     Subd. 8a.  [BAN; MERCURY MANOMETERS.] After June 30, 1997, 
  2.18  mercury manometers for use on dairy farms may not be sold or 
  2.19  installed, nor may mercury manometers in use on dairy farms be 
  2.20  repaired.  After December 31, 2000, all mercury manometers on 
  2.21  dairy farms must be removed from use. 
  2.22     Sec. 4.  [APPROPRIATION.] 
  2.23     $360,000 is appropriated from the general fund to the 
  2.24  commissioner of agriculture for the purposes of sections 1 to 3, 
  2.25  to be available for the biennium ending June 30, 1999.
