1.1 A bill for an act 1.2 relating to retirement; waiving annuity reduction 1.3 provisions for certain retired members of the teachers 1.4 retirement association. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [NO ANNUITY REDUCTION.] 1.7 (a) The annuity reduction provisions of Minnesota Statutes, 1.8 section 354.44, subdivision 5, do not apply to a person who: 1.9 (1) retires from employment as a teacher in a school 1.10 district with at least ten years of service credit in the 1.11 district from which the person retired; 1.12 (2) was employed by the district on a full-time basis 1.13 immediately preceding retirement; 1.14 (3) begins drawing an annuity from the teachers retirement 1.15 association; and 1.16 (4) returns to work in the district from which the person 1.17 retired to teach classes for which credit in a Minnesota 1.18 post-secondary institution is given and for which no other 1.19 qualified teacher is available to the employing district. 1.20 (b) A person covered by this section may not earn more than 1.21 $30,000 in a calendar year from employment in the district from 1.22 which the person retired. 1.23 (c) A person covered by this section may not earn further 1.24 service credit in the teachers retirement association as a 1.25 result of service under this section. 2.1 (d) This section applies to service performed during the 2.2 1993-1994 school year and subsequent years. The teachers 2.3 retirement association shall pay a person covered by this 2.4 section an amount equal to any reduction in the person's 2.5 annuities in those years in accordance with Minnesota Statutes, 2.6 section 354.44, subdivision 5.
