  1.1                          A bill for an act 
  1.2             relating to education; increasing limited English 
  1.3             proficiency programs revenue; amending Minnesota 
  1.4             Statutes 2000, section 124D.65, subdivision 5. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 124D.65, 
  1.7   subdivision 5, is amended to read: 
  1.8      Subd. 5.  [SCHOOL DISTRICT LEP REVENUE.] (a) A school 
  1.9   district's limited English proficiency programs revenue for 
  1.10  fiscal year 2000 equals the state total limited English 
  1.11  proficiency programs revenue, minus the amount determined under 
  1.12  paragraph (b), times the ratio of the district's adjusted 
  1.13  limited English proficiency programs base revenue to the state 
  1.14  total adjusted limited English proficiency programs base revenue.
  1.15     (b) Notwithstanding paragraph (a), if the limited English 
  1.16  proficiency programs base revenue for a district equals zero, 
  1.17  the limited English proficiency programs revenue equals the sum 
  1.18  of the following amounts, computed using current year data: 
  1.19     (1) 68 percent of the salary of one full-time equivalent 
  1.20  teacher for each 40 pupils of limited English proficiency 
  1.21  enrolled, or 68 percent of the salary of one-half of a full-time 
  1.22  teacher in a district with 20 or fewer pupils of limited English 
  1.23  proficiency enrolled; and 
  1.24     (2) for supplies and equipment purchased or rented for use 
  1.25  in the instruction of pupils of limited English proficiency an 
  2.1   amount equal to 47 percent of the sum actually spent by the 
  2.2   district but not to exceed an average of $47 in any one school 
  2.3   year for each pupil of limited English proficiency receiving 
  2.4   instruction. 
  2.5      (c) A district's limited English proficiency programs 
  2.6   revenue for fiscal year 2001 and later equals the product of 
  2.7   $584 times the greater of 20 or the number of adjusted marginal 
  2.8   cost pupils of limited English proficiency enrolled in the 
  2.9   district during the current fiscal year.  A district's limited 
  2.10  English proficiency programs revenue for fiscal year 2002 and 
  2.11  later equals the product of $750 times the greater of 20 or the 
  2.12  number of adjusted marginal cost pupils of limited English 
  2.13  proficiency enrolled in the district during the current fiscal 
  2.14  year. 
  2.15     [EFFECTIVE DATE.] This section is effective July 1, 2001.
