  1.1                          A bill for an act
  1.2             relating to gambling; creating a special account for 
  1.3             money received by the gambling control board as 
  1.4             reimbursement for costs of testing pull-tab dispensing 
  1.5             devices; appropriating money in the account to the 
  1.6             board for that purpose; amending Minnesota Statutes 
  1.7             1994, section 349.151, subdivision 4b. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 349.151, 
  1.10  subdivision 4b, is amended to read: 
  1.11     Subd. 4b.  [PULL-TAB SALES FROM DISPENSING DEVICES.] (a) 
  1.12  The board may by rule authorize but not require the use of 
  1.13  pull-tab dispensing devices. 
  1.14     (b) Rules adopted under paragraph (a): 
  1.15     (1) must limit the number of pull-tab dispensing devices on 
  1.16  any permitted premises to three; 
  1.17     (2) must limit the use of pull-tab dispensing devices to a 
  1.18  permitted premises which is (i) a licensed premises for on-sales 
  1.19  of intoxicating liquor or 3.2 percent malt beverages or (ii) a 
  1.20  licensed bingo hall that allows gambling only by persons 18 
  1.21  years or older; and 
  1.22     (3) must prohibit the use of pull-tab dispensing devices at 
  1.23  any licensed premises where pull-tabs are sold other than 
  1.24  through a pull-tab dispensing device by an employee of the 
  1.25  organization who is also the lessor or an employee of the lessor.
  1.26     (c) The board shall deposit in a separate account in the 
  2.1   state treasury all money the board receives as reimbursement for 
  2.2   the costs of services provided by independent testing 
  2.3   laboratories that have entered into contracts with the state to 
  2.4   perform testing and analysis of pull-tab dispensing devices.  
  2.5   Money in the account is appropriated to the board to pay the 
  2.6   costs of services under those contracts. 
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective July 1, 1995.
