  1.1                          A bill for an act 
  1.2             relating to corrections; limiting locations of 
  1.3             residence for level III predatory offenders; amending 
  1.4             Minnesota Statutes 2002, section 244.052, subdivision 
  1.5             4a. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 244.052, 
  1.8   subdivision 4a, is amended to read: 
  1.9      Subd. 4a.  [LEVEL III OFFENDERS; LOCATION OF RESIDENCE.] 
  1.10  (a) When an offender assigned to risk level III is released from 
  1.11  confinement or a residential facility to reside in the community 
  1.12  or changes residence while on supervised or conditional release, 
  1.13  the agency responsible for the offender's supervision shall take 
  1.14  into consideration the proximity of the offender's residence to 
  1.15  that of other level III offenders and proximity to schools and, 
  1.16  to the greatest extent feasible, shall mitigate the 
  1.17  concentration of level III offenders and concentration of level 
  1.18  III offenders near schools.  
  1.19     (b) If the owner or property manager of a hotel, motel, 
  1.20  lodging establishment, or apartment building has an agreement 
  1.21  with an agency that arranges or provides shelter for victims of 
  1.22  domestic abuse, the owner or property manager may not knowingly 
  1.23  rent rooms to both level III offenders and victims of domestic 
  1.24  abuse at the same time.  If the owner or property manager has an 
  1.25  agreement with an agency to provide housing to domestic abuse 
  2.1   victims and discovers or is informed that a tenant is a level 
  2.2   III offender after signing a lease or otherwise renting to the 
  2.3   offender, the owner or property manager may evict the offender. 
  2.4      (c) When an offender assigned to risk level III is released 
  2.5   from confinement or from a licensed residential facility to 
  2.6   reside in the community, the offender's approved release plan 
  2.7   must prohibit the offender from residing within 1,000 feet of 
  2.8   another offender assigned to risk level III, unless the offender 
  2.9   owned a residence within such area before the offender was 
  2.10  convicted.
