  1.1                          A bill for an act 
  1.2             relating to alcoholic beverages; creating a 
  1.3             legislative study committee to study issues 
  1.4             surrounding off-sales and wholesales by brewpubs. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [LEGISLATIVE STUDY COMMITTEE; OFF-SALE AND 
  1.7   WHOLESALE BY BREWPUBS.] 
  1.8      Subdivision 1.  [APPOINTMENT.] The chairs of the senate 
  1.9   committee on commerce and the house of representatives committee 
  1.10  on commerce, jobs and economic development shall establish a 
  1.11  study committee to study the issue of off-sales and wholesales 
  1.12  by brewpubs.  The committee shall consist of: 
  1.13     (1) two members of the senate appointed by the chair of the 
  1.14  committee on commerce; 
  1.15     (2) two members of the house of representatives appointed 
  1.16  by the chair of the committee on commerce, jobs and economic 
  1.17  development; 
  1.18     (3) four nonlegislative members appointed jointly by the 
  1.19  two chairs, representing the brewpub industry, labor, alcoholic 
  1.20  beverage retailers, and beer wholesalers; and 
  1.21     (4) the director of the division of alcohol and gambling 
  1.22  control of the department of public safety or the director's 
  1.23  designee.  Nonlegislative members of the study committee shall 
  1.24  serve without compensation. 
  1.25     Subd. 2.  [STUDY.] The legislative study committee shall 
  2.1   study and report on the feasibility and desirability of: 
  2.2      (1) permitting brewers holding on-sale licenses under 
  2.3   Minnesota Statutes, section 340A.301, subdivision 6, clause (d), 
  2.4   to sell their products at off-sale and wholesale; 
  2.5      (2) permitting other brewers with a limited brewing 
  2.6   capacity to obtain on-sale licenses; and 
  2.7      (3) permitting customers of such brewers to take home the 
  2.8   products of such brewers in a manner as similar as possible to 
  2.9   the removal of wine authorized under Minnesota Statutes, section 
  2.10  340A.404, subdivision 11. 
  2.11     Subd. 3.  [REPORT.] The study committee shall report to the 
  2.12  legislature on the results of its study by February 15, 2002.
