A bill for an act
relating to agriculture; directing the commissioner of
agriculture to make lump sum payments for catch-up
ethanol producer payments; providing for the timely
appropriation of money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; CATCH-UP ETHANOL PRODUCER
PAYMENTS.

new text begin $39,953,000, or as much of that amount as is available from
the deficiency in payments to ethanol producers specified in
this section, is appropriated from the general fund to the
commissioner of agriculture to make onetime payments on July 30,
2008, to ethanol producers for any deficiency in payments during
fiscal years 2004 through 2007 if the deficiency occurred
because appropriated money was insufficient to make timely
payments in the full amount provided in Minnesota Statutes 2004,
section 41A.09.
