A bill for an act
relating to the environment; establishing a grant program for idling reduction
technology purchases; appropriating money; proposing coding for new law in
Minnesota Statutes, chapter 116.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definition. new text end

new text begin As used in this section, "qualifying idling reduction
device" means equipment that is installed on a heavy-duty, diesel-powered, on-highway
motor vehicle to reduce long-duration idling of that motor vehicle and that is designed to
provide heat, air conditioning, or electricity that would otherwise require operation of the
main drive engine while the motor vehicle is temporarily parked or stationary.

new text begin The commissioner may award a grant to an
eligible applicant for up to 50 percent of the purchase and installation costs for one or
more qualifying idling reduction devices. An applicant is eligible for a grant under this
section if the applicant:

new text begin (1) is headquartered in this state;
new text end

new text begin (2) pays at least 50 percent of the purchase and installation cost for each idling
reduction device covered by the grant without the use of other financial assistance from
this state or from a local governmental unit in this state; and

new text begin (3) agrees to collect and report information relating to the operation and performance
of each idling reduction device covered by the grant, as required by the commissioner.

new text begin (a) Grant funds may be used for purchase and installation costs
incurred by the recipient for the purchase and installation of a qualifying idling reduction
device, if it will result in decreased emissions of one or more air contaminants from the
motor vehicle on which it is installed or decreased energy use by the motor vehicle.

new text begin (b) An applicant may apply for grant funds for up to one-half of the number of
heavy-duty, diesel-powered, on-highway motor vehicles the applicant owns and operates.

new text begin (c) The commissioner shall withhold payment of at least 20 percent of the grant until
the recipient has complied with the conditions established by the commissioner, including
providing any required information.

new text begin (d) The commissioner shall collect and summarize information from grant recipients
relating to the operation and performance of each idling reduction device and make the
information available for downloading free of charge on the agency's Web site.

new text begin (e) No more than 20 percent of grant funds awarded each fiscal year under this
section may be awarded to a single applicant.

new text begin (f) Twenty-five percent of grant funds awarded each fiscal year under this section is
reserved for applicants owning 20 or fewer trucks.

Sec. 2. new text begin APPROPRIATION.

new text begin $1,000,000 in fiscal year 2008 and $1,000,000 in fiscal year 2009 are appropriated
from the general fund to the commissioner of the Pollution Control Agency for the grant
program in section 1.
