  1.1                          A bill for an act 
  1.2             relating to human services; prohibiting drug or 
  1.3             alcohol abusers from receiving cash assistance under 
  1.4             general assistance and temporary assistance for 
  1.5             families unless the person is following a treatment or 
  1.6             aftercare plan; amending Minnesota Statutes 1996, 
  1.7             section 256D.05, by adding a subdivision; proposing 
  1.8             coding for new law as Minnesota Statutes, chapter 256J.
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 256D.05, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 9.  [PROHIBITING DRUG OR ALCOHOL ABUSERS FROM 
  1.13  RECEIVING ASSISTANCE.] A person who is a drug dependent person 
  1.14  as defined in section 254A.02, subdivision 5, is ineligible for 
  1.15  general assistance unless the person is following an approved 
  1.16  treatment program as defined in section 254A.02, subdivision 2, 
  1.17  or aftercare plan.  
  1.18     Sec. 2.  [256J.50] [PROHIBITING DRUG OR ALCOHOL ABUSERS 
  1.19  FROM RECEIVING TEMPORARY ASSISTANCE FOR NEEDY FAMILIES.] 
  1.20     A person who is a drug dependent person as defined in 
  1.21  section 254A.02, subdivision 5, is ineligible for temporary 
  1.22  assistance for needy families unless the person is following an 
  1.23  approved treatment program as defined in section 254A.02, 
  1.24  subdivision 2, or aftercare plan.
