  1.1                          A bill for an act 
  1.2             relating to emergency telephone services; requiring 
  1.3             provider of cellular telephone services to include in 
  1.4             its billings a notice regarding 911 calls; making 
  1.5             technical changes; amending Minnesota Statutes 1994, 
  1.6             sections 403.02, subdivision 1; 403.07, subdivision 1; 
  1.7             and 403.09; proposing coding for new law in Minnesota 
  1.8             Statutes, chapter 403. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 403.02, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [SCOPE.] For the purposes of sections 
  1.13  403.01 to 403.12 this chapter, the terms defined in this section 
  1.14  have the meanings given them. 
  1.15     Sec. 2.  Minnesota Statutes 1994, section 403.07, 
  1.16  subdivision 1, is amended to read: 
  1.17     Subdivision 1.  [RULES.] The department of administration 
  1.18  shall establish and adopt in accordance with chapter 14, rules 
  1.19  for the administration of sections 403.01 to 403.12 this chapter 
  1.20  and for the development of 911 systems in the state including: 
  1.21     (a) design standards for 911 systems incorporating the 
  1.22  standards adopted pursuant to subdivision 2 for the seven-county 
  1.23  metropolitan area; and 
  1.24     (b) a procedure for determining and evaluating requests for 
  1.25  variations from the established design standards. 
  1.26     Sec. 3.  Minnesota Statutes 1994, section 403.09, is 
  1.27  amended to read: 
  2.1      403.09 [ENFORCEMENT.] 
  2.2      At the request of the department of administration, the 
  2.3   attorney general may commence proceedings in the district court 
  2.4   against any person or public or private body to enforce the 
  2.5   provisions of sections 403.01 to 403.12 this chapter. 
  2.6      At the request of the public utilities commission, the 
  2.7   attorney general may commence proceedings before the district 
  2.8   court pursuant to section 237.27, against any public utility 
  2.9   providing telephone service which refuses to comply with the 
  2.10  provisions of sections 403.01 to 403.12 this chapter. 
  2.11     Sec. 4.  [403.13] [CELLULAR TELEPHONE USE.] 
  2.12     A provider of cellular telephone services in Minnesota 
  2.13  shall notify its subscribers a minimum of four times per year, 
  2.14  as a billing insert that a 911 emergency call made with a 
  2.15  cellular telephone is not answered by a local public safety 
  2.16  answering point but rather is routed to a state patrol 
  2.17  dispatcher and that, accordingly, the caller must provide 
  2.18  specific information regarding the caller's location.
