  1.1                          A bill for an act 
  1.2             relating to human services; requiring a sex offender 
  1.3             assessment; amending Minnesota Statutes 2000, section 
  1.4             609.3452, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 609.3452, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 1a.  [SEX OFFENDER ASSESSMENT.] When a person is 
  1.9   convicted of subsequent violations of section 609.342; 609.343; 
  1.10  609.344; 609.345; 609.3451; 609.746, subdivision 1; 609.79; or 
  1.11  617.23, or any other offense arising out of a charge based on 
  1.12  one or more of these sections, the court shall order a sex 
  1.13  offender assessment to be completed by the Minnesota security 
  1.14  hospital.  The assessment must contain the facts upon which the 
  1.15  assessment conclusion is based, with reference to the offense 
  1.16  history of the offender or the severity of the current offense, 
  1.17  the social history of the offender, and the results of an 
  1.18  examination of the offender's mental status unless the offender 
  1.19  refuses to be examined.  The assessment conclusion may not be 
  1.20  based on testing alone.
