  1.1                          A bill for an act
  1.2             relating to health; establishing requirements for 
  1.3             early and periodic screening, diagnosis, and treatment 
  1.4             programs; requiring an annual report to the 
  1.5             legislature; appropriating money; proposing coding for 
  1.6             new law in Minnesota Statutes, chapter 256B. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [256B.0947] [REQUIREMENTS FOR EARLY AND 
  1.9   PERIODIC SCREENING, DIAGNOSIS, AND TREATMENT PROGRAMS.] 
  1.10     Subdivision 1.  [PROGRAM REQUIREMENTS.] For an early and 
  1.11  periodic screening, diagnosis, and treatment program to be 
  1.12  approved by the commissioner of human services under Minnesota 
  1.13  Rules, parts 9505.1693 to 9505.1748, for medical assistance 
  1.14  reimbursement for early and periodic screening, diagnosis, and 
  1.15  treatment services, the program must satisfy the following 
  1.16  requirements: 
  1.17     (1) a program's screening component must include periodic 
  1.18  mental health assessments for children using valid, reliable 
  1.19  mental health screening tools disseminated by the commissioner; 
  1.20  and 
  1.21     (2) a program must complete and submit to the commissioner 
  1.22  an early and periodic screening, diagnosis, and treatment 
  1.23  services screening form, using a uniform format established by 
  1.24  the commissioner, for each child screened by the program, and 
  1.25  must provide the following information on the screening form: 
  1.26     (i) that each of the required screening assessments and 
  2.1   tests were completed for the child; 
  2.2      (ii) any possible physical, developmental, or mental health 
  2.3   problems identified by the screening; 
  2.4      (iii) if any possible problems were identified, whether and 
  2.5   to whom the child was referred for appropriate evaluation, 
  2.6   diagnosis, or treatment; and 
  2.7      (iv) if known, whether the child received further 
  2.8   evaluation, diagnosis, or treatment services and the results of 
  2.9   those services. 
  2.10     Subd. 2.  [DESIGN OF SCREENING TOOL AND UNIFORM EARLY AND 
  2.11  PERIODIC SCREENING, DIAGNOSIS, AND TREATMENT SCREENING 
  2.12  FORM.] The commissioner must design and disseminate to early and 
  2.13  periodic screening, diagnosis, and treatment programs approved 
  2.14  under Minnesota Rules, parts 9505.1693 to 9505.1748: 
  2.15     (1) a mental health screening tool; and 
  2.16     (2) a uniform early and periodic screening, diagnosis, and 
  2.17  treatment screening form that includes the components in 
  2.18  subdivision 1, clause (2). 
  2.19  The screening form must allow programs to submit data in a 
  2.20  manner that does not individually identify any child being 
  2.21  screened. 
  2.22     Subd. 3.  [EVALUATION OF UNIFORM EARLY AND PERIODIC 
  2.23  SCREENING, DIAGNOSIS, AND TREATMENT SCREENING FORM.] Using the 
  2.24  uniform early and periodic screening, diagnosis, and treatment 
  2.25  screening forms and any other data needed from early and 
  2.26  periodic screening, diagnosis, and treatment programs, the 
  2.27  commissioner of human services shall monitor and provide annual 
  2.28  reports to the legislature on changes for recipients of 
  2.29  screening services in access to mental health assessments and 
  2.30  mental health treatment services.  The annual report shall be 
  2.31  issued each January 15 beginning January 15, 2003. 
  2.32     Sec. 2.  [APPROPRIATION.] 
  2.33     $....... is appropriated for the 2002-2003 biennium from 
  2.34  the general fund to the commissioner of human services for the 
  2.35  design of a mental health screening tool and a uniform early and 
  2.36  periodic screening, diagnosis, and treatment screening form 
  3.1   under Minnesota Statutes, section 256B.0947, subdivision 2, and 
  3.2   an evaluation of the effect of the screening form under 
  3.3   Minnesota Statutes, section 256B.0947, subdivision 3.
