  1.1                          A bill for an act
  1.2             relating to state government; requiring the 
  1.3             commissioner of employee relations to provide 
  1.4             affirmative action officers for state universities, 
  1.5             community colleges, and technical colleges; amending 
  1.6             Minnesota Statutes 1994, section 43A.191, subdivision 
  1.7             1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 43A.191, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [AFFIRMATIVE ACTION OFFICERS.] (a) Each 
  1.12  agency with an approved complement over 1,000 shall have at 
  1.13  least one affirmative action officer, who shall have primary 
  1.14  responsibility for developing and maintaining the agency's 
  1.15  affirmative action plan.  The officer shall devote full time to 
  1.16  affirmative action activities.  The affirmative action officer 
  1.17  shall report administratively and on policy issues directly to 
  1.18  the agency head. 
  1.19     (b) The commissioner shall assign affirmative action 
  1.20  officers for agencies with approved complements of less than 
  1.21  1,000.  
  1.22     (c) The commissioner shall employ and assign persons to 
  1.23  serve as affirmative action officers in institutions under 
  1.24  control of the higher education board.  Each institution shall 
  1.25  reimburse the commissioner for costs of this service. 
  1.26     Sec. 2.  [TRANSITION.] 
  2.1      For institutions under control of the higher education 
  2.2   board, powers and duties of affirmative action officers are 
  2.3   transferred to the department of employee relations, under 
  2.4   Minnesota Statutes, section 15.039. 
  2.5      Sec. 3.  [EFFECTIVE DATE.] 
  2.6      Sections 1 and 2 are effective July 1, 1995.
