  1.1                          A bill for an act 
  1.2             relating to information; creating the governor's 
  1.3             council on information policy reform to review 
  1.4             information policy law and make recommendations on 
  1.5             updating these laws; sunsetting the data practices 
  1.6             law; appropriating money; repealing Minnesota Statutes 
  1.7             1996, chapter 13. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [GOVERNOR'S COUNCIL ON DATA PRACTICES REFORM.] 
  1.10     Subdivision 1.  [CREATION; MEMBERSHIP.] There is created a 
  1.11  governor's council on information policy reform consisting of 
  1.12  the following members: 
  1.13     (1) five commissioners of state agencies, or their 
  1.14  delegates, appointed by the governor; 
  1.15     (2) three members with sufficient background and 
  1.16  professional expertise in the field of data practices, appointed 
  1.17  by the commissioner of administration; 
  1.18     (3) the director of the office of technology; 
  1.19     (4) a member knowledgeable in media and communications 
  1.20  appointed by the director of the office of strategic and 
  1.21  long-range planning; 
  1.22     (5) two members representing diverse communities, or 
  1.23  private citizens with unique perspectives regarding information 
  1.24  policy, appointed by the governor; 
  1.25     (6) one member appointed by the attorney general; 
  1.26     (7) one member of the Minnesota State Bar Association 
  2.1   appointed by the association; 
  2.2      (8) one member of the Citizen's League appointed by the 
  2.3   league; 
  2.4      (9) one member from each of the following educational 
  2.5   organizations appointed by the organization:  School Boards 
  2.6   Association and Minnesota Association of School Administrators; 
  2.7      (10) one member from each of the following local government 
  2.8   organizations appointed by the organization:  League of 
  2.9   Minnesota Cities, Association of Minnesota Counties, Minnesota 
  2.10  Association of Small Cities, and Minnesota Association of 
  2.11  Townships; and 
  2.12     (11) two members of the senate with one minority member and 
  2.13  one majority member appointed by the subcommittee on committees 
  2.14  and two members of the house with one minority member and one 
  2.15  majority member appointed by the speaker of the house. 
  2.16     Subd. 2.  [TERMS; COMPENSATION.] Members shall serve at the 
  2.17  pleasure of the appointing authority.  Members shall receive 
  2.18  compensation and expense reimbursement as provided by Minnesota 
  2.19  Statutes, section 15.059, subdivision 3. 
  2.20     Subd. 3.  [DUTIES.] The council shall examine all 
  2.21  information policy laws to determine to what degree they advance 
  2.22  personal privacy, facilitate public access to government 
  2.23  information, and ensure that government programs and activities 
  2.24  are operated in an efficient fashion.  The council shall 
  2.25  evaluate statutes dealing with information policy to determine 
  2.26  if they are inconsistent or obsolete.  
  2.27     Subd. 4.  [SUPPORT.] The commissioner of administration and 
  2.28  the director of the office of strategic and long-range planning 
  2.29  shall provide staff and other support services to the council. 
  2.30     Subd. 5.  [REPORT.] On or before February 1, 1998, the 
  2.31  council shall present to the chair of the committee on judiciary 
  2.32  in the house and the chair of the committee on judiciary in the 
  2.33  senate a report containing its findings and recommendations.  
  2.34  The report shall include a bill that amends or repeals statutes 
  2.35  dealing with information policy in conformance with report 
  2.36  recommendations. 
  3.1      Sec. 2.  [APPROPRIATION.] 
  3.2      $....... is appropriated from the general fund to the 
  3.3   commissioner of administration for the purpose of section 1, to 
  3.4   be available until June 30, 1999. 
  3.5      Sec. 3.  [REPEALER.] 
  3.6      Minnesota Statutes 1996, chapter 13, is repealed June 30, 
  3.7   1998. 
  3.8      Sec. 4.  [EFFECTIVE DATE.] 
  3.9      Sections 1 and 2 are effective the day after final 
  3.10  enactment.
