1.1 A bill for an act 1.2 relating to courts; eliminating filing of duplicate 1.3 documents; updating the law governing court 1.4 administrators; amending Minnesota Statutes 1998, 1.5 sections 279.13; 485.018, subdivision 2; repealing 1.6 Minnesota Statutes 1998, sections 357.07; and 485.018, 1.7 subdivisions 1 and 4. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1998, section 279.13, is 1.10 amended to read: 1.11 279.13 [AFFIDAVIT OF PUBLICATION.] 1.12 The owner, publisher, manager, or lead supervisor in the 1.13 printing office of the newspaper in which such notice and list 1.14 have been published shall forthwith make and file with the court 1.15 administrator of the district court an affidavit of such 1.16 publication, stating the days on which such publication was made 1.17and shall also file with the court administrator three copies of1.18each number of the paper and supplement, if any, in which the1.19notice and list have appeared. The publication may be made in 1.20 such newspaper, or partly therein and partly in a supplement 1.21 issued therewith. The affidavit shall be substantially in the 1.22 following form: 1.23 1.24 State of Minnesota ) 1.25 ) ss. 1.26 County of ............... ) 2.1 ..............., being first duly sworn, deposes and says 2.2 that ..he is the ....................... (here state whether 2.3 affiant is owner, publisher, manager, or lead supervisor) of 2.4 ............................. (here state name of newspaper), 2.5 in which was printed the notice and list of real estate 2.6 remaining delinquent in ..................... county on the 2.7 first Monday of January, .......; that the notice and list were 2.8 duly printed and published in the newspaper on each of the 2.9 following days: On ........... (day of week), the 2.10 ................... day of ........................, ......., 2.11 and ........................ (day of week), the 2.12 ....................... day of ...................., .......; 2.13 and that each of the days on which the notice and list were so 2.14 published was the usual and regular day of the issuance and 2.15 publication of the newspaper. 2.16 .................................. 2.17 Subscribed and sworn to before me this 2.18 ............................. day of 2.19 ......................................, ....... 2.20 Sec. 2. Minnesota Statutes 1998, section 485.018, 2.21 subdivision 2, is amended to read: 2.22 Subd. 2. [SET BY BOARD.] The county boardof each of the2.23counties specified in subdivision 1annually shall set by 2.24 resolution the salary of the court administrator of district 2.25 court which shall be paid to the court administrator of district 2.26 court at such intervals as the board shall determine but not 2.27 less often than once each month. At the January meeting the 2.28 board shall set by resolution theminimumsalary to be paid the 2.29 court administrator of district court for the term next 2.30 following. In the event a vacancy occurs in the office of the 2.31 court administrator of district court the board may set the 2.32 annual salary for the remainder of the calendar year at an 2.33 amount less than was set for that year.The board in any case2.34specified in this subdivision may not set the annual salary at2.35an amount less than the minimums provided in subdivision 1 but2.36it may set the salary in excess of such minimums.The salary of 3.1 the court administrator of district court shall not be reduced 3.2 during the term for which the court administrator is appointed. 3.3 In the event that duties are assigned to the court 3.4 administrator of district court which are in addition to the 3.5 court administrator's duties as court administrator, additional 3.6 compensation may be provided for the additional duties. The 3.7 county board by resolution shall determine the additional 3.8 compensation which shall be paid and specify the duties for 3.9 which the additional compensation is to be paid. 3.10 Sec. 3. [REPEALER.] 3.11 Minnesota Statutes 1998, sections 357.07; and 485.018, 3.12 subdivisions 1 and 4, are repealed.
