  1.1                          A bill for an act 
  1.2             relating to intermediate care facilities for persons 
  1.3             with mental retardation; authorizing a pilot project 
  1.4             to demonstrate the closure of a 64-bed facility; 
  1.5             appropriating money. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PROJECT AUTHORIZATION.] 
  1.8      For the biennium ending June 30, 1997, the commissioner of 
  1.9   human services may authorize a pilot project to demonstrate the 
  1.10  closure of a 64-bed intermediate care facility for persons with 
  1.11  mental retardation or related conditions (ICF/MR) which serves 
  1.12  persons who require significant medical services and supports.  
  1.13  The commissioner may provide sufficient home and community-based 
  1.14  allocations to implement this pilot project and to achieve the 
  1.15  relocation of residents from the facility which is closing.  The 
  1.16  allocations may be assigned to residents of the closing facility 
  1.17  or to other ICF/MR residents who may receive home and 
  1.18  community-based services as a result of this pilot project.  The 
  1.19  commissioner may authorize the reuse of allocations at this 
  1.20  higher rate level provided that new persons require a comparable 
  1.21  level of care and applicable federal and state regulations have 
  1.22  been met.  The maximum average cost of the waiver allocations 
  1.23  shall not exceed 125 percent of the average cost that would have 
  1.24  been spent in the ICF/MR, including day training and 
  1.25  habilitation and case management.  The payment rate for the 
  2.1   closing facility shall be determined under the provisions of 
  2.2   Minnesota Statutes, section 252.292, subdivision 4. 
  2.3      The pilot project must be approved by the commissioner 
  2.4   under Minnesota Statutes, sections 252.28 and 252.292, and must 
  2.5   include: 
  2.6      (1) measures to ensure that residents or their legal 
  2.7   representatives are informed of choices for service options and 
  2.8   service vendors; and 
  2.9      (2) the criteria and process which will be used to select 
  2.10  individuals for alternative services. 
  2.11     Sec. 2.  [APPROPRIATION.] 
  2.12     $....... is appropriated from the general fund to the 
  2.13  commissioner of human services for the purposes of section 1, to 
  2.14  be available until June 30, 1997.
