  1.1                          A bill for an act
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             articles X, section 8; XI, section 14; and XIII, 
  1.4             section 5; prohibiting the legislature from 
  1.5             authorizing any form of gambling, and nullifying all 
  1.6             existing laws that authorize any form of gambling. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.9      An amendment to the Minnesota Constitution is proposed to 
  1.10  the people.  
  1.11     If the amendment is adopted: 
  1.12     article X, section 8, will be repealed, 
  1.13     article XI, section 14, will read: 
  1.14     Sec. 14.  A permanent Minnesota environment and natural 
  1.15  resources trust fund is established in the state treasury.  The 
  1.16  principal of the environment and natural resources trust fund 
  1.17  must be perpetual and inviolate forever, except appropriations 
  1.18  may be made from up to 25 percent of the annual revenues 
  1.19  deposited in the fund until fiscal year 1997 and loans may be 
  1.20  made of up to five percent of the principal of the fund for 
  1.21  water system improvements as provided by law.  This restriction 
  1.22  does not prevent the sale of investments at less than the cost 
  1.23  to the fund, however, all losses not offset by gains shall be 
  1.24  repaid to the fund from the earnings of the fund.  The net 
  1.25  earnings from the fund shall be appropriated in a manner 
  1.26  prescribed by law for the public purpose of protection, 
  2.1   conservation, preservation, and enhancement of the state's air, 
  2.2   water, land, fish, wildlife, and other natural resources.  Not 
  2.3   less than 40 percent of the net proceeds from any state-operated 
  2.4   lottery must be credited to the fund until the year 2001.  
  2.5      and article XIII, section 5, will read: 
  2.6      Sec. 5.  The legislature shall not authorize any lottery or 
  2.7   the sale of lottery tickets, other than authorizing a lottery 
  2.8   and sale of lottery tickets for a lottery operated by the 
  2.9   state form of gambling.  Any law in effect on November 5, 1996, 
  2.10  that authorizes any form of gambling is void on and after July 
  2.11  1, 1997. 
  2.12     Sec. 2.  [SUBMISSION TO VOTERS.] 
  2.13     The proposed amendment must be submitted to the people at 
  2.14  the 1996 general election.  The question submitted must be: 
  2.15     "Shall the Minnesota Constitution be amended to prohibit 
  2.16  the legislature from authorizing any form of gambling, and to 
  2.17  repeal all existing laws that authorize any form of gambling? 
  2.18                                    Yes........
  2.19                                    No........."
