  1.1                          A bill for an act 
  1.2             relating to workers' compensation; changing a rate 
  1.3             calculation; amending Minnesota Statutes 1994, section 
  1.4             79.211, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 79.211, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [CERTAIN WAGES EXCLUDED INCLUDED FOR 
  1.9   RATEMAKING.] The rating association or an insurer shall not 
  1.10  include wages paid for a vacation, holiday, or sick leave in the 
  1.11  determination of a workers' compensation insurance premium. 
  1.12     An insurer, including the assigned risk plan, shall not 
  1.13  include wages paid for work performed in an adjacent state in 
  1.14  the determination of a workers' compensation premium if the 
  1.15  employer paid a workers' compensation insurance premium to the 
  1.16  exclusive state fund of the adjacent state on the wages earned 
  1.17  in the adjacent state.
