  1.1                          A bill for an act 
  1.2             relating to state government; providing for a cap on 
  1.3             agency fees. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [CAP ON AGENCY FEES.] 
  1.6      Notwithstanding any other law to the contrary, a state 
  1.7   agency may not impose a fee that is higher than the fee in 
  1.8   effect on December 31, 1994.  In emergency situations, the 
  1.9   agency may request a waiver from the legislative commission on 
  1.10  planning and fiscal policy.  The commission, in consultation 
  1.11  with the governor, shall approve or deny the request.  
  1.12     For the purposes of this section: 
  1.13     (1) fee means a charge for goods and services and any 
  1.14  regulatory, licensure, or other similar charges levied by a 
  1.15  state agency and paid by individuals, businesses, or other 
  1.16  nonstate entities, not including general taxes collected by a 
  1.17  state agency or charges for services provided by one state 
  1.18  agency to another state agency; and 
  1.19     (2) agency has the meaning given in Minnesota Statutes, 
  1.20  section 16A.011. 
  1.21     Sec. 2.  [EFFECTIVE DATE.] 
  1.22     Section 1 is effective on the day following final enactment.
