  1.1                          A bill for an act
  1.2             relating to commerce; regulating videotape 
  1.3             distributions; requiring certain captioning for deaf 
  1.4             or hard of hearing persons; providing penalties and 
  1.5             remedies; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 325I. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [325I.05] [VIDEO CAPTIONING.] 
  1.9      Subdivision 1.  [REQUIREMENT.] A person may not in the 
  1.10  ordinary course of business distribute a prerecorded 
  1.11  videocassette tape or similar audio-visual material to a 
  1.12  videotape seller or videotape service provider unless it is 
  1.13  open-captioned or closed-captioned for the deaf and hard of 
  1.14  hearing. 
  1.15     For purposes of this section, "videotape seller" and 
  1.16  "videotape service provider" have the meanings given them in 
  1.17  section 325I.01. 
  1.18     Subd. 2.  [ENFORCEMENT.] A person who violates this section 
  1.19  is subject to the penalties and remedies provided in section 
  1.20  8.31, except subdivision 3a. 
  1.21     Subd. 3.  [APPLICATION.] This section applies to 
  1.22  prerecorded videocassette tapes or similar audio-visual material 
  1.23  that: 
  1.24     (1) is primarily produced for sale to educational 
  1.25  institutions, training facilities, state or local government 
  1.26  agencies, or medical facilities; and 
  2.1      (2) is released or rereleased on or after June 1, 1997, and 
  2.2   more than 500 copies are produced in the release or rerelease; 
  2.3   or 
  2.4      (3) is produced by a governmental entity for educational 
  2.5   purposes.
